Browse Forums Building A New House 1 Jan 13, 2010 8:42 am I went to see a solicitor yesterday to ask about what my chances are of winning when going to VCAt and the costs invovled. She basically said that we would win, but its unusual for anyone going for less than 30k and the costs would be about 10k, which are hardly ever awarded to the winning side. I was wondering, has anyone been to VCAt, and have you represented yourself there and what was the outcome. This is all building up to the final payment on my build which is 10 months late, we are on our 12th site supervisor, with numerous other errors that are too many to list. cheers Re: has anyone been to VCAT? 2Jan 13, 2010 9:20 am I haven't been to VCAT but I am suing a removals company for damaging our possessions and claiming to have bogus insurance. My total claim is for $1600 and they have paid $600 already (but won't pay the rest). I think you can sue for any amount, within reason. I will be lodging my forms with VCAT within the next week. I will watch this thread as I am keen for more info too. Blog: http://bluemistkids.blogspot.com "Never be afraid to try something new. I think Hels will be using the Civil Claims part of VCAT which the lodgement is approx $36.00 I imagine you would be going via the Building act which is different fees I stand to corrected but I believe VCAT can only order the work to be rectified but they do look after building licences of course builders value these very much. There are heaps of detailed info re. collecting your evidence and preparing yourself etc., but I only looked at that for a NSW equivalent; I'm sure there is a site for VIC explaining the same. Even the fees are all there. BTW, for NSW at least, you can't go directly to the Tribunal - you have to try with Dept of Fair T first ... My signature is distracting people from my wise posts ... Re: has anyone been to VCAT? 7Jan 13, 2010 4:04 pm You can go to VCAT with any claim. You get a chance to put your case in a very informal way, the other side can ask questions and the guy at the front decides, or asks both sides if they want to compromise etc.. Don't take a legal person, take a friend. Take lots of ******** sheets. It really is friendly and easy, I highly recommend it.
