Our neighbours are near completion and one side wants to erect a fence. This includes 6 metres of tubular fencing at the front of the property. As far as I knew, it's not a requirement to fence the front of your property in Innisfail. I spoke with someone at PEET who is the developer and they said that it's now a requirement. From what I can see from driving around, very few newly constructed houses have this tubular fencing. Can anyone who has recently built or currently building shed some light on this? In the sections of the estate near Sneydes Rd/Ponsford Dve a lot of the houses have that fencing. It says you can't erect a colourbond fence less than 1.8m. In front of the house on the sides you can't erect a tubular fence less than 1.2 metres, and at the front you can't erect a fence without a combination of brickwork and metal. I checked our contract of sale last night and it's vague on what is mandatory. Under the fencing section it states that The Proprietor Shall NOT build or allow to be built 1. Side or boundary fences between the Lots which are less than 1.8 metres in height and not capped and which are in any material other than colour bonded steel sheeting the colour of which is other than........etc 2. any fence between the side boundary fence and the private dwelling house which is not consistent in height and colour and material to the side boundary fence and which is forward of the front building line 3. side boundary fences between the Lots which are forward of the front of the building line which are more than 1.2 metres in height and which are constructed of material other than powder coated tubular...etc 4. any front boundary fence which is constructed of material other than brick, rendered brick masonary, wrough iron, powder coated steel,....etc It actually doesn't say what must be built. Re: Fencing Requirements Innisfail Point Cook 6Jan 13, 2010 9:27 am As you say, that's simply stipulating the types of fences which are allowed, but doesn't say anything about where fencing MUST be erected. If that's the only reference to fencing in the contract and there's no clause that refers to a separate document (such as a developer design guidelines booklet) and states that you must comply with all requirements set out in that document, then it would seem that the extra fencing forward of the building line is not compulsory. If so, and it's just something your neighbour wants, then you're not obliged to contribute to the cost. Go back to the developer and ask them to refer you to the clause in the contract that compels you to have this extra fencing. When I pointed out that most newly constructed homes don't actually have it she said that as long as you have the colour bond fencing for now and do the tubular in the future.
