Browse Forums Building A New House 1 Dec 31, 2009 3:31 pm So big drama in building. We have in our contract we want stained wooden posts on the front portico and back alfresco. The posts are in and are primes and the beams are stamped with black logos. We discussed the fact clearly this wood cannot be stained. The site supervisor says there is stain look paint. PD (our building co) says they do not offer stain anymore and we will have to pick a paint colour. To us this is totally unacceptable as our signed contract says stain, and only after us complaining about the wood have they said no stain. A few Q's 1) would you simply accept a refund on staining cost $250 or want more for doing something different from our contract. 2) Any suggestions for the poles?? We have brown bricks, woodland grey roof/gutters etc and a red front door. We cant think of any paint colour that may work. We are thinking rust effect paint, or covering them in gray stack stones. Any suggestions much appreciated! We had a similar issue with timber infills above our bifold doors. Our lovely doors were to be stained and varnished and some idiot installed treated pine for the infills. We insisted that it be removed and replaced with hardwood - treated pine would have looked really naff; the green shows through stain and wouldn't have matched the doors. We did have to ask more than once, and made sure we put it in writing, but we won. If your SS won't come to the party, complain in writing to your construction manager (his name should be listed on 24/7) with a cc to your CSC. He just wants the easy way out He stuffed up + your contract stipulates stained posts = stained posts ! Case in point : our contract stipulated an outlet on our ducted vacuum motor. Well it doesn't have one. We dug in our heels & insisted that they honour our contract. Result : we're getting the wrong motor taken out & the correct one installed. What's in the contract is in the contract. Just make sure any communication is in WRITING. PD have just gotten really lazy and don't want to pay the painter extra to sand it down smooth and stain it. I would dig my heels in and make them provide stain grade timber. I'm peeved off with PD regarding stain. We paid extra to have stain grade handrails on our staircase....and the stained finish on it looks crappy. Why? Because PD only pay for 2 coats of stain. If the lazy painter won't sand down between coats...then 2 coats isn't going to look nice. I'm not expecting french polish....but I would expect that a painter would sand before staining, stain, sand again and then stain. Not wack on 2 coats of stain and call it a day! Seriously a refund of $250 is not going to get you very far. Dig your heels in, contractually they have to supply stain grade timber and stain them to the colour you specified in your contract. Don't fall for the old "we don't do that any more" line. If it's in the contract, you get it. End of story. It's a different thing when it comes to tile or tap manufacturers discontinuing a particular item - then you have no choice but to pick a replacement. But something like stain-grade timber isn't going to be discontinued.... The are alway quick to point out to us when something is not in the contract so it goes both ways just not in there favor, if the site supervisor will not fix tell him you will take it further up the food chain.
