Browse Forums Building A New House 1 Dec 19, 2009 3:25 pm Hey, We just decided that maybe we want to do the retaining walls at the front of our house (as our house is quite low in to the ground so from our front windows we are looking at a pile of dirt) we haven't asked our builders as it was just an after thought today. Do you think we would be allowed? or will we get in trouble for our builders?? Is anyone else doing any work at their land while there builders are on holidays?? I'd really love to do our walls over the break while the builders are away, and we're sure they'd let us (unofficially) because we've done other stuff, but we've decided that summer is not a good time for heavy duty outdoor work. Great idea though if you can handle the heat. If their office is closed, you could leave a message stating your intention? That way they might get it after the break when the walls are already done! We will probably get a landscape gardener to do the designs and then do the work ourselves. I would say also to check with your builder/supervisor. The term "possession of site" is in contracts to describe the contractors right to enter the site, occupy or use the site and carry out the specified works. During the contract period, possession will usually involve such exclusive occupation and use the site as required to construct the works. Possession of site is needed so that risks can be apportioned. If they stuff something up...they are responsible. If you stuff something up...the lines can be blurred and you can pretty much guaranteed you'll end up with more then your share of the liability. We also got permission from our Site Supervisor to build both front and rear retaining walls, and then the SS was replaced: New guy wanted to charge us a PCV for allowing access and all sorts of penalties because we'd access the site, etc. Eventually we argued all that away due to other failings by the builders, but it really was our fault. Just got an email back today saying that they dont see any problems with it and just make sure we dont wreck the water, gas r electricity so I think we'll do it!!! Ours has made it very clear that we are not allowed any of our own trades on site whatsover (we too wanted to build the outside walls during the break), and in fact as of 2 weeks ago we have been advised that we are "no longer welcome" on our own site, and have to arrange a mutual time once a fortnight to view latest works Our build has been one long nightmare ....
