Browse Forums Building A New House 1 Nov 30, 2009 9:38 am HI All, We have finally decided on the builder and got a draft contract available from the builder to look at Fingers crossed if everything works out alright, we might have the contract signed in time to get the 25K grant. However, I have a few questions, Hopefully someone can answer them for me soon. The draft contract mentions: 1) Issue of Planning permit: is that something thats our responsibility? What does that mean? 2) Statutory Land charges and Developers charges: what are they and why are they responsibility of the owner again? The contract is a Victorian new Homes contract. An orange coloured copy with green qriting in it. I am being paranoid, as I have never seen a contract copy before and its a bit scary getting into a big commitmment... Thanks all. All builders who are HIA members can use the HIA building contract clauses as it is a legal document, plus builders do not need to fork out any more money to get a lawyer to re-draft any clauses when they can just use the HIA format. The difference is of course the front few pages, pertaining to compensation, payment schedule, interest charged on late payment, plans, etc. I got a lawyer specialising in building contract to go through the contract, what are the reasonable risks to myself, owner and builder responsibilities. It was money worth spending especially when I am committing to building.Contact the Law Institute of Victoria, or maybe BACV if they can point you to some law firms.
