I was wondering if someone could point me in the right direction. Our builder has changed the story of the cause of damage to our fence. (It was removed to put in new retaining.) Originally we were told that the fencing broke up during a storm while it was ****** down after removal. However, I have been told by our new Construction Co-ordinator that the fencing broke during removal. They insist that it was old (hardiflex) and broke up as it was removed. We are currently getting it reclarified to see what the correct story is as we have already approached the neighbours for cost of repair as the building commission advised that it was storm damage, and I have told them that it is going to be embarrassing to have to pull out of the claims because we were not told the truth.
However, if the cause of damage is because of removal I do not believe this. I have removed old fencing at my parents - older than our was - and we dug deep and carefully removed it and it didn't break up. Is this true? And is there anywhere that I can get this information formally so I can argue with the builder that it was not removed carefully? I'm guessing they didn't dig it up properly or dropped it/stepped on it. And my father agrees, and so does my Uncle who worked as a building supervisor for 10 years. They think it's odd that over 40m of fencing broke up because it was old during removal. They could understand one or 2 pieces, but not the entire fence.
And any idea how to approach the builder to get them to pay for it instead of us? I'd like to get ready if the new story is the case so I can get ready to fight for the money.
