Browse Forums Building A New House 1 Dec 16, 2009 2:21 pm We drove past our block today and found that the back neighbours have already put a fence up. I dont know much about this, but from what Id heard, most people consult with the owner and get 3 quotes and then decide what they want? Our block settled a few weeks ago and the fence went up about a week ago so they could have got in contact with the council and consulted us? I know its really no big deal, but if Im paying for a fence id like to have a say in what im paying for? Does that mean I dont have to pay?? Or am i just going to get a bill in the mail Re: erecting a fence and payment?? 2Dec 16, 2009 3:13 pm chances are a bill in the mail. If you wanted to fight it though you could go and get your own quote and pay half of that. Although that may get your relationship with your neighbors off to a bad start. ---------------------------------------- Building the PD Lisbon 24 http://www.porterdavis.com.au/#homeviewer/lisbon/24 Blog of our progress. http://lisbon24.blogspot.com/ Homeone build thread https://forum.homeone.com.au/viewtopic.php?f=31&t=28665 Re: erecting a fence and payment?? 3Dec 16, 2009 3:20 pm makoby We drove past our block today and found that the back neighbours have already put a fence up. Or am i just going to get a bill in the mail It is my understanding from what I've read on this site. If the neighbour has not notified you of their intentions and consulted with you on quotes and styles etc. Then the cost becomes theirs alone. You should not have to pay anything. If they do attempt to bill you, get further information on the action you could take, from your local council regarding the Dividing Fences Act in your state. On a side note this exact same thing has just happened to us. We haven't commenced building yet but our neighbours have just finished and have now erected a really nice fence with no consultation with us. We've owned the land for nearly 6 mths, so they could have easily contacted us. So I guess they don't mind paying for it themselves. Good news for us Re: erecting a fence and payment?? 4Dec 16, 2009 4:08 pm It can often take a lot longer than a few weeks to organise quotes and a time for the fencer to come out and do the actual work, who owned the land before you they may have paid for half of it. I agree, legally you dont have to pay, but morally you should. If they informed the previous owner, by a "notice of intent to erect a fence" the previous owner legally needs to pay, but I dont like your chances on that one. Some people have pets and cant wait to contact new owners before erecting a fence. regardless, your contract stipulates a payments schedule and SOPA doesn't give provision to that scenario.
