It should be against Boral too as they would have known the truth all along! Will it get anywhere but Did georges fair legally have to tell us I would have thought that Liverpool council should be as much to blame as the others. The way I see they've sold the land to that guy at a bargain basement price saying he can build a recycling plant and then turned around later and allowed Georges Fair and now Brighton Lakes to be developed. Its like they thought the quarry would never be filled in and developed so sold off that bit of land then got approached by Investa and just saw dollar signs that rates would bring in from that many houses and hoped that what is happening now wouldnt come up. If council have deemed Brickmakers as under a 5t weight limit can that be reversed if this plant goes ahead ? Re: Anyone building at George's Fair, Moorebank? 6063May 15, 2015 11:44 pm Hi Johnno, The land involved in the proposed Moorebank Recyclers site was sold by a private entity (Mayne Nickless) to Concrete Recyclers many years ago for $10 000 - it was never owned by the Council. Thanks we are building at Georges Fair currently, we contacted the council today to find out the same thing and they told us we have to fill out a form with them. But the previous post advising you to contact the developer seems quicker - I might give that a try that instead. We moved into our house in Georges Fair 3 months ago and wanted our fences up as soon as possible for privacy and security for our puppy. At the time, our neighbour hadn't started building yet but we contacted them and they were happy to pay for half. Next door has now started building and their site manager got in contact with us saying we need to remove our fence to allow them access to brick where the corner of their garage meets the fence. The site manager is claiming that it is my responsibility to remove and re-erect the fence and all at my expense, however I fail to see how this could be my responsibility when I don't need the fence removed. I have asked him for a fencing notice to be prepared and given to me detailing how much of the fence will be removed, when this will take place, what provision will be put in to secure my land and specifying that he is liable for any damage done to my property as a result. Am I completely in the wrong here? I called council and they completely agree with my approach and that I am correct in my understanding of responsibility. Has anyone else been in this position and can provide some clarity? It is only the corner of their garage that will be on the fence line. The house is angled so it's not the entire wall effectively replacing the fence. He said he will build it half way (up to my side enterance) and then he will build a temporary fence around it. Then once the neighbour house is up, he will continue with the rest. Note that the neighbour might need the space for their scaffolding etc so he said it will be best to leave it until their house is up. Re: Anyone building at George's Fair, Moorebank? 6075Jun 23, 2015 10:27 am I'd guess this is zero boundary, which from memory means the wall needs to be 100mm off the boundary line (not exactly zero). But zero boundary or not, I would think that if a neighbour needs to pull a fence down for any reason other then a faulty fence etc, then the costs should be from the person pulling the fence down. Sounds obvious to me, which isn't always the legal way, but I wouldn't think the builder has a leg to stand on. I'd outright refuse and ask for him to show you legal proof that it's your responsibility. Where their garage meets the zero boundary is next to bathroom and bedroom windows so for our own privacy we didn't want to wait. Hey HoudaMan, Yes I guess that's where my understanding and logic stands too. Basically the SS is now saying it is nothing to do with him and is between myself and my neighbour, but I think it has everything to do with him given he needs the access to proceed with the build. I called our site manager today and he is completely on our side and says that he would not go about things in that way and he would only remove the fence as an absolute last resort and would instead brick from the inside of the garage. It must be sucks when their SS asked you to cover all the cost like that is your fault. Have you talk to your neighbour about this? Re: Anyone building at George's Fair, Moorebank? 6078Jun 24, 2015 8:51 am We also went through the same thing and even spoke to the owner who didn't want to help in removing the fence even though they also paid for part of it. So without support from council and anyone else really, we removed the fence and posts and had to also close up the gap ourselves, it just shows what kind of neighbours we will be getting next door.
Mind you we now have to redo that area on the side of the house and purchase a new gate. If it was me building 2yrs after my neighbours have built i would of offered to help remove the fence/posts and help close the gap, but not everyone is nice.
