When you are counting building days and keeping a diary - do you a) Count every day through the week? e.g Day 1 (M) Day 2 (T) Day 3 (W) Day 4 (Th) Day 5 (F) Day 6 (Sat) Day 7 (S) Day 8 (M) OR b) Count only weekdays? e.g. Day 1 (M) Day 2 (T) Day 3 (W) Day 4 (Th) Day 5 (F) Day 6 (M) Day 7 (T) Would you do the same even if your builder DOES NOT work on weekends? I count actual days including weekend days. If your builder in the contract stated for example that the build should take 220 days i think it would need to also stipulate that this is just working days if this was the case otherwise include weekend. As it doesn't specifically say working days, I assume I count the weekends too (even though I know they don't work weekends). Additionally, I'm taking contruction to actually mean digging of trenches, not just peg layout. Mind you we already have 3 letters extending our finish date by a total of 15 days due to 'bad weather'. Oh well, this is really all just for labelling of photos, it won't really matter if I end up saying Day 380 but they are really only up to Day 330. Thanks for all your help. Vic HIA building contract this is on pages 15-17. in this, Days = calender days. You would be surprised, Saturday is usually very busy on our site. Even had the plaster there literally all day on a Sunday! Never assume anything.... your contract should have a "definitions" section where it clarifies commonly used terms. It also should specify exactly what constitutes commencement of construction. Ours was 167 (calendar) days from site scrape. I would think that these details matter rather a lot: whether it's Day 330 or Day 380 will affect whether you get paid compensation for late completion. A ******* contract that leaves basic concepts open to interpretation makes it easy for the builder to take their sweet time and suffer no penalties. Mine is on page 6 of the HIA contract. Like I said: never assume anything. A "strong suggestion" may not stand up in a court of law.
