I'm currently building with Metr1con and we're also being penalised heavily. On my preliminary contract, the very first page it is stated in bold letters as follows: "If, when the New Home Contract is prepared, it is evident that the contract may not become unconditional within 150 days of deposit, due to factors beyond the builder's control, then a price rise may be applicable. Refer to item 5 of the Acknowledgements." Well, I couldn't find the item 5 of the "Acknowledgements" but I could find item 5 of the "Agreement" on my preliminary contract stating the following: "5. H. (that is item number 5 clause H) - In the event that the Purchaser and Metr1con Homes enter into a New home Contract such contract shall contain a provision that if the Contract cannot become unconditional within 150 calendar days from the date of payment of initial deposit, due to factors beyond the Builder's control, then the New Home Contract will be priced on the following basis: - Between 150 and 365 days from deposit, an increase of 0.5% of the total contract value will be applied per month or part thereof. - Over 12 months from deposit, the New Home Contract price will be reviewed and prepared based on prices applicable at the time." Hey Jeuno, OMG its another fellow Metr1con builder!!! What are you building? M should have penalised us as of mid Jan, however they have been at fault much of the time, so I think thats the reason why they havent. Josie: That is a killer penalty is that a % on your total cost or on the base price? Generally penalties are based on % of base price. And like Jeuno said you cant really do much as you've signed the contract and agreed to the terms and conditions. Its possible if you have found the communication and processing of contract by PD slow, then perhaps you can negotiate with them. I managed to get Metr1con to waive a engineers report because they took too long to get one. We finally got developers approval last week so next week we apply for the building permit. Fingers crossed we start next month. I cant remember what my site costs were exactly but I think they were less than 8k we had to get 2 pillars at the rear due to being close to easement and sandy soil. Land Purchased: 23rd December 2009 Land Settled: 14th December 2010 Developer Approval: 18th January 2011 Building Permit: 20th January 2011 Site Scrape: 9th February 2011 Slab Poured: 23rd February 2011 Build thread: viewtopic.php?f=31&t=43214 Re: Somerfield Estate Keysborough 219Mar 23, 2010 1:08 pm We are building the cooper home, bcz we liked the house plan, but have changed a lot like front door double, front windows stuff (Timber) in order to get it into our standard, the reason why I choose this plan was I could get a bigger house for less money and I have added what I wanted to make it nicer, and our house is bigger than their cooper, its about almost 28sq, its not bad, it will come up like a clendanvale home eventually.
