I meet a big problem. This afternoon I made a tender appointment with pd. everything is ok but the site cost are so high. I listed as follow: site costs: $1,931 slab upgrades: $9,099 services (provide stormwater to 100mm under future driveway concrete, re-establishment survey, second soil test):$1,629 OH&s: $1,272 it is so high. what about your site cost? Jason Hi, does pd staff require you to provide compaction infill report ? they said the slab class will be based on that report. If slab class are based on that report, why they make the soil test? I really confused. I don't understand why they did soil test twice for me. they explain that the first test failed due to unfinished subdivision. Therefore, I should pay twice. it is unreasonable. PD advised me today that due to us not starting on time we will be charged an extra $13500!! so unfair as this is not our fault but due to Akron Roads going into liquidation I am not prepared to pay this I am wondering if anyone else has had the same problem??? I am so annoyed with the develpors as the work has taken far too long even taking into account the delays with Akron Someone has to pay this not us!! I'm currently building with Metr1con and we're also being penalised heavily. On my preliminary contract, the very first page it is stated in bold letters as follows: "If, when the New Home Contract is prepared, it is evident that the contract may not become unconditional within 150 days of deposit, due to factors beyond the builder's control, then a price rise may be applicable. Refer to item 5 of the Acknowledgements." Well, I couldn't find the item 5 of the "Acknowledgements" but I could find item 5 of the "Agreement" on my preliminary contract stating the following: "5. H. (that is item number 5 clause H) - In the event that the Purchaser and Metr1con Homes enter into a New home Contract such contract shall contain a provision that if the Contract cannot become unconditional within 150 calendar days from the date of payment of initial deposit, due to factors beyond the Builder's control, then the New Home Contract will be priced on the following basis: - Between 150 and 365 days from deposit, an increase of 0.5% of the total contract value will be applied per month or part thereof. - Over 12 months from deposit, the New Home Contract price will be reviewed and prepared based on prices applicable at the time." Also I refer to katmeow's quote on page 4. katmeow Yup. The builder gives u a certain amount of days of when ur home contract will need to become unconditional from ur first initial deposit with them. Else, u will be penalized a certain % of your total contract price per month for the extension unless the delay is caused by the builder. We learned it the hard way that "Unconditional" means ready to go=construction ready to start (at least that's what our builder says). We thought we could save by signing with the builder early before they increase base prices of the house few months back when we first bought the land. In the end, we still have to fork out more $$$ due to the delay of the title registration. Nothing you can do about it as the developer doesn't need to compensate for it either and it's not the builder's fault so it all comes down to more $$ penalty to the owner. Unless the delay are your builder's cause, then they cannot penalise you. In your case, I'm sorry to say but I think you don't really have much option . If you haven't sign the final contract, you could probably do some mathematical calculation on whether to cancel the contract and start over again and lose the initial $1000 deposit plus $3000 preliminary at the maximum. Also do take into consideration the amount of time you will have to redo the color, electrical selection all over again. The base price of the house probably would have gone up a bit. Any upgrades you've made to the house probably have gone up in prices a little bit as well. New promotion, are they worth changing etc... If canceling and restarting again is a better option for you, then maybe speak to your Consultant or their manager first and let them know of your intentions as they might be very *understanding* and save you from all the hassles from starting over and agree to relieve you from the penalty altogether wishful thinking. Hey Jeuno, OMG its another fellow Metr1con builder!!! What are you building? M should have penalised us as of mid Jan, however they have been at fault much of the time, so I think thats the reason why they havent. Josie: That is a killer penalty is that a % on your total cost or on the base price? Generally penalties are based on % of base price. And like Jeuno said you cant really do much as you've signed the contract and agreed to the terms and conditions. Its possible if you have found the communication and processing of contract by PD slow, then perhaps you can negotiate with them. I managed to get Metr1con to waive a engineers report because they took too long to get one. We finally got developers approval last week so next week we apply for the building permit. Fingers crossed we start next month. I cant remember what my site costs were exactly but I think they were less than 8k we had to get 2 pillars at the rear due to being close to easement and sandy soil.
