Browse Forums Building A New House 1 Sep 25, 2009 12:20 pm Hi, all My wife and I are planning to build with M-etricon in Berwick, and going on Sunday to talk to the land office and get started on the whole process. I hasten to add that this is after tonnes of research, looking at plans etc, so we're definite on what we want. We're first home owners and so we want to sign the contracts by the 31/12/09 deadline to qualify for the full $25k (Sep 30's the deadline for the $32k, but oh well!). I have a couple of questions hopefully someone can answer - 1. Is 2.5-3 months a likely timeframe to sign the contracts? 2. Will the SRO accept some kind of preliminary contract before the 31/12?* *I know from a SRO brochure I read that they will be willing to accept late applications in exceptional circumstances, examined on a case-by-case basis. I really should phone them, but I only have a couple of minutes left on my lunch break. I think that 3 months is more than enough time to draw up a contract to be signed.. Any changes to the design/layout etc, can be raised as variations, which do not change the original contract you have signed. We have not done our colour selections or tiles selection as yet. These will be added as variations to our contract with no penalty as Andrew has stated. Just let them know that you want to have the building contract ready before this date. You need to have a slab down 26 weeks after signing your contract. I would want a written start date from the builders that manage this rule. Justin. We did our selections 2-3 months after contract signings, and applied them all as PCVs. As far as I can tell theres no such thing as a "Preliminary Contract" -- only a fully legal and binding contract that happens to have some parts (ie. the colors, floor selection) as after signing variations, but it will contain $ allowances for these in the tender. We signed such a contract and the only place the word preliminary is mentioned is over the top of the house plan contained inside, as our actual house will be flipped plan and that's it. M usually "close the gates" well prior the current deadline to people hoping to sign by the deadline and have done a month or more in advance of both the June 30th and Sept 30th deadlines....
Delivering a building contract is generally not the biggest issue. My concern is when is the land titled? If you dont have land that is titled be sure that you sign the contract as late as possible in December, especially if the land is not predicted to be available till March or later, as you still need to get a slab down within 26 weeks of signing. Every estate I know of in the region is running behind and I would seriously add a month or 3 to any time the developers are saying...Understand that the builders know that people are using the grant to make up the short fall and lots of deals are dependant on getting a specific amount. If they delay and dont provide you a contract in time they know the deal will fall over and they would usually only take on as many clients as they can manage before the dead line....The rule seems to be the bigger the builder the earlier they close the gates... With developers however, make sure when buying land that you have an expected title release date somewhere in writing. If the date on the land list is longer that what the agent is telling you dont rely on what the agent says as if the release is later you will not get dispensation from the SRO (state revenue office) as you have no recourse...Lets say you sign by the 15 th of Dec, the agent tells you the land is ready in April, but the land list says May, but in reality the land is released due to standard delays, in July, by the time the builder gets the house to site well over the 26 weeks from signing will have elapsed and an extension would need to be sought from the SRO...that is what is meant when they say a case by case basis. They sent us a letter (which we can use if an extension is needed I presume) stating late October 2009. I emailed them recently and they said December 2009. So nrook, is right, add a few months!
