Browse Forums Building A New House 1 Sep 18, 2009 5:06 pm Just a quick question - is it normal for builders to provide you with the final contract and then ask you to sign it at the same time?? I would have thought that you would get a copy to read over a few days rather than just signing it then and there... Re: Receiving the contract and signing straight away?? 2Sep 18, 2009 5:25 pm I'm not sure Piper, with my builder, he actually gave me the final plans etc with the contract to look at, and we made a time for me to go into their offices a couple of days later to go over the contract fully, and even then i didn't have to sign it!! viewtopic.php?f=31&t=22766 - my build thread! Time waits for no man. Unless that man is Chuck Norris. Re: Receiving the contract and signing straight away?? 3Sep 18, 2009 5:40 pm Hi Piper Our builder told us a similar thing, saying that if we didn't sign straight away we would experience all sorts of delays.. I still insisted that our solicitor read the contract though, very glad we did.. I would definitely advise you get legal advice before you sign ANYTHING Re: Receiving the contract and signing straight away?? 4Sep 18, 2009 6:04 pm Reading the stories on here, I think it is quite normal. We got a "generic copy" of a filled out HIA contract from our builder 3 weeks before we needed to sign. This had the details of damages, percentage progress payments and construction time filled out, basically all the variable stuff. There was an expectation (but it was not mandatory) that on presentation of the drawings and HIA contract that you would sign on the spot and hand over your deposit amount. FYI, We did sign on the day for a few reasons, I definately wouldn't have if the generic copy wasnt provided prior so I could understand the contract before hand. Re: Receiving the contract and signing straight away?? 5Sep 18, 2009 6:08 pm If you've never received a prelim copy of the contract before, then you definately have the right to take the contract home for at least a couple of days to read them carefully. Dont fall for their bull*@#% because 2 or 3 days wont make any difference. If they pressure you to sign on the spot, take your time and start going through the contract carefully and ssslloooowwllyyy....then just casually mention to them you might take at least an hour if they dont mind waiting. Just to annoy them. 12 March 2010 - Land titles received 3 April 2010 - Signed building contract 14 April 2010 - Prestart 28 April 2010 - Loan approved 30 June 2010 - Slab completed 27 August 2010 - Brickwork completed 22 September 2010 - Roofing completed 30 September 2010 - Internal walls plastered 12 October 2010 - Lock Up 19 November 2010 - PCI 26 November 2010 - Handover 29 December 2010 - Moved In https://forum.homeone.com.au/viewtopic.php?f=31&t=32584 Re: Receiving the contract and signing straight away?? 6Sep 18, 2009 6:10 pm We had a "tender" appt which went for 3 hours and we went over every detail of the contract. Contract signing was a few weeks later and we made a few changes in that time. Blog: http://bluemistkids.blogspot.com "Never be afraid to try something new. Re: Receiving the contract and signing straight away?? 7Sep 18, 2009 6:48 pm Piper if youa re building a PD Access you don't go to tender - saves a LOT of time! Also, your CSA should give you a generic copy of the HIA contract before your contract appointment so you can read through it - when you read it you will see its heavily weighted to their favour and they wont really change anything! They will walk you through each and every page of the HIA contract and the drawings and you need to sign/initial every page of them! If anything is wrong they can fix it with a Post Contract Variation (PCV) either done on the spot or delivered later If you want a copy of the HIA contract earlier, I have a PDF of it at work that I can send you on Monday if you give me your email address via PM 'A bottle of wine contains more philosophy than all the books in the world.' I just didn't want to go into the appointment and have to try and absorb who knows how many pages of legal stuff in a short period of time. I'd love a copy of the generic contract, I'll send you a PM. Re: Receiving the contract and signing straight away?? 9Sep 18, 2009 8:38 pm Just a question on the generic HIA contract - when it comes to Clause 10 about payments if they go over the completion date, it obviously doesn't state a number. Do you have to negotiate this at your contract signing or do most companies have a set amount?? (I'm in Vic if that helps). Cheers Caz & Co ALL MOVED IN!! Now comes all the hard work-decorating.... Cheers The default for Vic HIA contract, as per the contract is $250 per week. My builder has it as $250 on mine but it really should be say close to what you are paying in rent currently but good luck on trying to negotiate this!
