Oh and we found out our SS is P and our admin is R, so not the same as you and Cinny... Spoke to P today. He is cool with the wiring etc but wants it to be at agreed stages, like just before plastering. Our admin was still towing the official Henley line though. When I emailed her and asked her to get P to contact us re wiring she was all, "just so you know, you won't be allowed to do anything except telephone..." Pffffffff. Just answer the phones woman. haha. Most of our dealings will probably be directly with our SS. Will just have to ring 'home' if something goes wrong! How's your house going? Re: Our H3nley Voyager 383- debt collection notice :-( 74Oct 19, 2009 9:16 pm Well the excitement of our hassle free adjoining fence has waned as we received a notice from a debt collection agency last week. Am pretty p****** off about this because we contacted the owners (a building company) about the fence in March and they have ignored all of our letters and phone calls, built the fence anyway and now want us to pay their ridiculous price. FYI- we got four fencing quotes- this company's quote was $400 dearer than our preferred fencer! Needless to say, we are not paying it Have written an email to the debt collection weasels and am awaiting their reply. Has now been four business days since email sent.... Not sure if we will even get a reply! In response to your letter dated 6/10/09 regarding the recovery of funds for the fence built by U-****A Fence (commissioned by H**** Homes) we wish you to pass on the following information to your client: • After having obtained three fencing quotes, we sent the owners of Lot XXX a letter in April (see attachment) and a quote (the cheapest of the four) for their share of an adjoining fence. We had no reply. • We received a ‘Notice to Fence’ dated 29th May from U-****A Fence, ignoring our previous correspondence and quote and requesting we pay $1072.50 for them to construct the fence. • We responded with a second letter (see 2nd attachment) in which we explained we were unwilling to pay that price for the fence as our quote is significantly cheaper. We had no response to this letter. • We received a ‘Letter of Demand’ from U-****A Fence dated 14th July. Upon receiving this letter I rang U-****A Fence. I spoke to *****. She confirmed that the owners of Lot XXX and U**** A Fence had received our two previous letters and quotes. I asked why they had ignored these letters. *****said “we weren’t sure if your quote was for exposed post and capping fencing.” I asked why they had sent a letter of demand and not telephoned us or written to us to clarify the query they had with our quote. ***** told us, “we didn’t have your phone number.” I pointed out that they had our address and might have sent the query in writing. I said I would telephone our preferred fencer to ask if the quote was for exposed post and capping and promised to call back. I did so; confirming with ***** that our quote and U-****A Fence’s quote were for a ‘like’ product. I told *****, as we had also written in the letter, that I hoped we could contribute an agreed amount to the cost of the fence. I asked her how we would come to this agreement. She replied, “leave it with us. Now that we’ve got your fencer’s details, the two companies will work it out amongst themselves. And we’ve got your phone number, we’ll let you know.” • Nobody from U**** A Fence ever got back to us with an agreed quote. I have spoken to our preferred fencer, and their manager confirmed that U **** A Fence never contacted him to “work it out amongst themselves.” • The adjoining fence was constructed without us being given the opportunity to agree on a fair half contribution. In addition to the fence being erected without our consent, the fencers removed the rear boundary peg (which is not necessary). As a result of this, we are currently facing the prospect of our builder charging us a $800 re survey fee. • The Fencing Act states that if the adjoining owner is not given an opportunity to agree to a half share of the fence, then we are not obliged to pay. Therefore, as we contacted your client, notified them of our objection to their quote and they ignored our objection and built the fence anyway we are not liable for the cost of this fence. Please pass on this information to your client. I don't know how we'll go.... But this mob have been so unethical in the way they've dealt with the whole thing. Have spoken to our lawyer and apparently we're in the right... Just depends how far the fencing company wants to pursue it! Just read over the whole of your last post and you sound like you gave them every chance to respond to your letters/quotes ... Why should you have to pay extra. I've only spoken to people who had their neighbours pull down existing fences (and build new one) without their consent, and I'm pretty sure the law for construction of a new fence is different to replacing an existing fence. It makes it very hard why you are dealing with the direct owner ... Nobody wants to lose any harmony between neighbours. I have 66 meters of fence to do, 33 meters each side with the rear of the property already done and paid before i brought the land. Ive rang around and the cheapest i have found is $75 a meter for the double sided timber pailing fence @ 1.8m high with exposed posts ... TOTAL of $4950 but half i pay $2475 and the other is for the neighbour eitherside of me. If either neighbour of mine finished the build first and put a fence up without my approval and costing more, i would tell them to go jump too. You have every right.
