Browse Forums Building A New House 1 Sep 16, 2009 8:46 am Hi everyone, What do you do when your neighbour decides that they want to put a fence in that you totally don't agree with? We met one of our neighbours yesterday who told us that they want to put in a 1.5m chainlink fence with metal posts and frame. We have decided that all of our other fence sides are going to be 1.2m with pine posts and dog wire. The neighbour on the other side agrees. We think that this will suit our block and fit in with the neighbourhood as we will be living on acreage. The fence in question is quite large (97m long). I have a couple of issues with the chain link fence: 1. It will cost more than we have budgeted for 2. It is a different height than we have on the other sides 3. It is ugly and will make our block look like a basketball court. 4. The ugly fence is in the direction of our main view. 5. The woman is quite pushy and has her heart set on the ugly fence. What can we do about this? Do we have any legal rights? Any suggestions or similar experiences would be great. Who's paying for the fence..i think qld if you pay for the whole thing you can do what you want. If you want them to go halves...then it gets more "fun". We wanted colourbond our neighbours wanted to keep their falling over timber paling, cyclone fencing mix fence. We now both have a fence...we paid for the colourbond fence...they kept theirs..they're right next to one another. For us, it would be silly to have 2 fences because both of them are see through. If they pay for the whole thing then that would take the sting out a bit, but I still don't want to look at an ugly basketball court fence everyday! I also don't want to get off to a bad start with the neighbours before we even move in. I was thinking that maybe I should give them a call soon to let them know we aren't really happy with their fence idea and try to reach a compromise. Unfortunately this woman seems really set on metal. Any other suggestions? You dont have to agree on what she wants, they can't make you pay for a more expensive fence than what is standard in the area. Best just to read the act it is online. Mum & Dad had this issue on there acreage block qld the neighbour just put the fence up inside his boundry at his expence, they got a heap on dirt in built up a mound garden and planted it out with natives 1year on it is almost blocked out. But I do agree with you they are a ugly fence. Do they have big dogs they need to keep in and therefore need the higher stronger fence? Perhaps they would be willing to have your fence if you increase the height? We have border collies (crazy jumpy dogs) and a 1.2m fence - they have never attempted to jump the fence The main reason that the woman wants the fence is because she thinks that the wooden posts rot and need to be replaced every couple of years. Her reasoning is that she 'just wants to put up a fence and forget about it' my concern it that I won't be able to stop thinking about it because it is sooooooooooooo ugly! I guess we will have to make some gardens, but a 97m long garden is a rather large job! Does anyone know of any other types of fences that will suit acreage, posts won't rot, and don't look super ugly? Are you sure they are border collies? We have dogs of a similar size and will need to double fence our yard as 1.2 metre fences will not keep them in nor keep other dogs out. Re: Help with fencing dispute 9Sep 16, 2009 5:00 pm Yeah..they didn't want to budge..they thought it was a perfectly acceptable fence as is and I didn't want timber (because it's already eaten out by termites) and I didn't want to waste my time and the stress of going to mediation etc over the fence so just bit the bullet and have 2 fences. Must looks silly from their side though as our fence is higher and half of their fence is cyclone mesh (see through). Basically if you want a fence you send your neighbour a registered letter with the notice of intent to erect a fence with all the details. Then your neighbour needs to disagree in writing within 30 days. If she dosnt reply you get to build the fence you want and she gets to pay half. If she disagrees in writing you need to go to mediation or court. Have you tried to explain that the fence she wants is ugly, and costs more maybe she dosnt know. Tell her in $$$ that if she wants her fence it will cost $$$$ more than your idea. In my experience the older neighbours they dont really mind as long as it dosnt come out of their back pocket. Re: Help with fencing dispute 13Sep 17, 2009 6:24 pm ^^ I'd be careful with the way you worded it though, as you wouldn't want to step on their toes/offend them buy just saying "your fence will be ugly". My only bit of advice would be to just build your own fence on your side. Unfortunately you'll still be able to see her fence. Maybe take her around a couple of brochures to show her the warranty period of post fences? And where it says how they're treated? I told her all of my concerns including the fact that I thought it was a 'not very visually appealing' fence (how's that for tactful?!). I also told her that I was concerned about the price and the fact that it will be taller than all of our other fences. She is a complete nightmare and doesn't seem to get it. I am soooooooooooooooooooo frustrated!!! She is obviously one of those pushy types that seems to get away with it. She won't even concede to not having a metal bar across the top as she reckons her dogs will pull the fence down without it. I don't see why I should have to pay for her naughty dogs! What I plan to do is, when she presents a quote, show her the quote that we have and say that we are only prepared to pay for half of the cheaper fence price. I think I am going to have to accept that we are going to look like we live on a basketball court So unhappy but don't know what else to do.... Any other suggestions? I am SERIOUSLY desperate!!! Just tell her straight that you are only prepared to pay half of the cost of the smaller fence with the posts, for asthetic and finacial reasons. If she wishes to do something else then she pays the full cost and you want nothing to do with it. Then let her decide what to do. Re: Help with fencing dispute 16Sep 20, 2009 6:00 pm I agree with Hels, compromise has to happen on both sides and if she want to go ahead and build a fence that you don't agree with that she is to do it on her side of the boundry at her expense and that you will only pay half of a fence that you both agree on building and that is standard to the area which is what a judgement would come to in mediaiton.
