Browse Forums Building A New House 1 Sep 15, 2009 5:21 pm Hi all, So the story is, we have moved into our house as of Friday 4th September. Everything was fine. Monday 7th September i received a phone call from the developers of the estate stating that the fence that our builders have put up (which is included in our contract) does not comply with the colour palette that has been set and apparently our builders have been trying to wash their hands of it. Thursday 10th September, i receive another call from the developer stating that due to the builders not wanting to cooperate about the fence, we have 2 weeks to take the fence down otherwise we will be taken to court. Now, this gets me pretty upset and i end up in tears. Friday 11th September, my FH goes out and sees our builders about this problem, taking our land contract with him. The 'legal guy' that is employed by the builders takes a copy of the contract and says that he will look over the contract and speak the MD about it all. Monday 14th September, FH receives call from 'legal' guy saying that he could not find anything in our contract stating that their is a covenant on the land with the colour palette (was clearly marked by our solicitor!), and they will not be doing anything about the fence. When FH was there on the Friday, he brings up about the fact that our builders have been remindered about the colour palette numerous times and actually have a few copies of the land contracts which clearly states all of this information. FH also bring up the fact that the managed to do the driveway correctly according to the colour palette, and he has no come back to that. In our building contract, we have a colourbond fence included. To stop this going to court, we are also willing for them to replace the fence with the timber fence that we are allowed to have as the colour bond fence that is included in the palette, is a new profile and has to be a specific colour and there is only 2 fence companies who do this fence and they are already 6 weeks behind with the fences (and the fact that the required colourbond fence is about $10,000 worth!) We have now lodged a complaint with the department of fair trading, and have been told by 2 different people there that we have a very good case against our builders.
