Browse Forums Building A New House 1 Aug 11, 2009 5:17 pm Hi everyone, We are days away from handover with our builder, but there are many outstanding jobs that the builder has said he will finish when we move in . Our friends also built with him and he did return to complete outstanding jobs. But it goes against the grain to pay for jobs not completed with any tradesman, regardless of their promises. We also have made some variations along the way so we owe him, but also he owes us for some allowances that we used our own suppliers for (probably a mistake in retrospect because he makes it up in other areas so he doesnt need to pay you back). Unfortunately he is a small builder and hasnt documented the contract variations etc but this has also worked in our favour in some areas. Can anyone give us any advice on the final handover and any negotiation tips for the final payment. Re: Negotiating final payment 3Aug 12, 2009 4:16 pm I know it can be hard, but I wouldn't move in until all defects have been completed. I think by memory the contracts state that the builder has 21 days to complete the defects after the defects list has been given to them. When everything is complete, pay him, get the keys and move in. You could also hold some money from the final payment until all defects have been complete (if the builder agrees). Contractually the builder doesn't have to handover the keys unless they have received the final payment. The builder can however give you written notice that you can take possession of the building even though the final payment has not been made. THey can then fix everything, and you pay upon completion of the defects.
