Browse Forums Building A New House 1 Jul 24, 2009 6:52 pm I always thought 5 days meant 5 business days. Can anyone clarify? I am being pressured to pay. I was send an invoice on Monday 20th July at 2:17pm and got an email at 10:47 Friday 24th of July saying payment is due... What the!!! Thats only 92.5 hours. I emailed back and said 5 days is actually 120 hours. He also dosn't think its his problem I didn't read my emails that day. Why can't people be reasonable. We were sent our slab invoice and we realised that the money we have invested (that will be used for the first couple of progress payments) matured a few days after our payment time was up. I rang the contact at our builder and explained the situation and wondered if it could be a few days late. "No problem, thanks for letting us know." was the response I recieved. Your builder seems a bit full on to me. I leave you to fend for yourself, figure things out yourself. I didn't read my email until the 21st,and truth be told still havent opened the attachment. I got the invoice in the mail after bank closing times on the 21st. I dont know why they are pushing so hard, maybe they are short cash flow. According to the HIA contract they have a right to charge 15% if not paid within 5 days. I know bank transfers can take more than 5 days, why dosnt the builder understand that. Our builder is the same as Joles - we have any issues we phoned the accounting dept and let them know when to expect the money. They have been fine so far. Some things are worth waiting for. He believes sending an email consitutes receipt of said email..imagine if i was away for a week what would happen then! Re: 5 days for progress payment...vent 14Jul 24, 2009 8:15 pm payment terms are generally based on the date of the invoice - the date the invoice is received has nothing to do with it. if the invoice is dated 17th then 5 working days would be 24th. that said though - if they didn't email the invoice through it would have been received on the 20th via snail mail and the due date would still be 24th. So yes they can suspend works until it is payed. Technically you have another 7 days after it becomes due for them to actually suspend the works. Can you forward the original email back to them as that will have the date it was sent to you. Our builder has been pretty good as long as we ring them to let them know what is going on they are o.k. Legally the builder can pursue you for being in breach of contract. Most building contracts are 5 days from date of invoice but few builders follow through unless it gets way overdue. Our bank is having an absolute shocker. they have not got it right once. i thank my lucky stars we are building for our selves with the contract going through my father in law. The latest is a letter from the banks debt collection dept advising us we are late in payments despite the fact the bank has still not got a proper loan account in place. they are covering us under a temporary transaction account which is simply used to transfer money to our account. The interest rate is 16% which i have refused to pay as the rate we agreed is written in the loan contract. so to date we have paid nothing and the bank manager and my solicitor both agree that i am well within my right to continue not paying until the bank sorts its S#!t out. Dont stress too much, just let your bank know that the builder is chasing payment and remind them of the contract terms which they are obliged to follow.
