Either the OP signed the wrong plans to begin with, or the SS issued magnifying glasses as standard site apparel - how could not one of the tradies say "hang on a minute ..." ? They've contracted and paid a lot of money to get a house built...building the wrong house isn't like putting on the wrong gutter colour it's a HUGE mistake. If you commisioned anything else...say a custom made entertainment unit, with specific sizings for your room or a wedding dress (just for something different) or [insert any other expensive item here] and they built/made the wrong thing/size would that ever be acceptable, and would the person refuse to pay..I'd say they would? Why should the house be any different...esp considering it's a much bigger purchase. Whose house did they build? At what point did it go wrong? At what point did they realise? And why was your property manager directed to the wrong house? How frustrating for you!! If only they had accidentally built a bigger house!!! Then you could have had a better investment property for no extra cost. I can't help but cringe on behalf of the builder - what a monumental stuff up!!! But it will be interesting to see what arrangement they propose. It's going to be in their best interest to make sure you are very satisfied with the eventual outcome and I'm sure they'll want to do whatever is necessary to keep things from getting ugly. Which should work in your favour! But, unless they give you such a fantastic deal on the wrong house that it makes it worthwhile, I think you should get the house you signed for (perhaps on another block?) plus substantial compensation. It's going to be hard to make sure that your potential investment income isn't compromised. Good luck with it all and keep us posted! We're home!!! As this house is an investment property, there may be room to move in that we are not talking about someone's dream block and dream this and that. It's an investment. Is there a possibility of the builder buying you out of this house and then rebuilding the correct house on another similar block? Obviously in this scenario the builder would be footing the bill of the increase in block price (if any), all legal fees and paying compensation for lost income in the time it takes to build. But it may be a way for you to get what you paid for, not be out of pocket and the builder doesn't have to be destroyed in the process. If this is not a possibilty, I'd be finding out what the rental return difference is for the house you signed for and the house you built and also the resale difference. I'd then be using these figures as the basis of working out some type of compensation. I leave you to fend for yourself, figure things out yourself.
