Browse Forums Building A New House 1 Jun 24, 2009 12:22 pm We are looking to build with builder "B" and were given a copy of the "General Specification to Building" which we were asked to acknowledge receipt of the copy. In it, it generally says everything that is not in the contract will be borned by the owner at cost plus 20% margin. It also states that any damage to the council kerb while in construction are to be repaired and paid by the owner, which I felt is not fair. We were told that we would have to sign this to agree with the terms stated in it when we signed the contract later on but I felt that almost all the terms in there are favourable to the builder. I was wondering if any of you are given something similar to sign when you build your house. Thanks. Re: General Specification to Building 2Jun 24, 2009 4:45 pm Fantastic!! well not realy as part of the council requirements before a builder goes to site start is they must take photos and document items like crossover,curb, fences etc at the completion of the build the council comes out to see if anything has changed. any addition damage during the construction period is borne by the builder. tell then your wont proceed and then you should see them change. Re: General Specification to Building 5Aug 14, 2009 4:55 pm We are building in Kuringgai and as part of that we had to pay a levy to the council whereby they will repair any damage to the infrastructure up to that value. Our Builder had the same or similar clause and I made them change it to read "The owner indemnifies the builder for any damage to council property including footpaths, kerb, guttering other than negligence or wilful damage. The builder shall act diligently to minimise any potential for damage at all times. " Its the best you can do, it sort of makes sense, they will bring trucks in, materials etc etc, and it will cause wear and tear on the road, you could just imagine the cost that they could be exposed to if they are working on infrastrucutre that has not been maintained. Your argument will be with council, again it is not for you to fix back to new just to the state it was in prior to the building. the clause i had them include means that they are responsible to not overload trucks, not drive on teh road with metal tracks, as this would be akin to negligence or wilful and not acting to minimise damage.
