Re: What happens if a neighbour disagrees with protection notice 2Jun 17, 2009 6:17 pm Neither of my neighbours disagreed but I did have to do a lot of accommodating because I knew one of them would be difficult. At the end of the day, there is not a lot you can do about it. It is much easier to pacify rather than fight them as it will only delay the work and get them offside. In my case, I altered my boundary footings from a strip footing to piers and suspended edge beams to eliminate any impact to the neighbours structure. It cost me a fair bit more, but my work got done and I didn't do any damage to the neighbouring structure. From my understanding of the rules (in Vic anyway), my neighbour would have been well within his rights to hire a structural engineer or similar to supervise the work and investigate any degradation to his structure before/after and I would have to foot the bill! Not to mention being liable for any damage to the structure. The other person was far less of an issue. The offer of keeping things clean, replacing a few plants and fixing the timber fence were enough to get an approval. All of which will cost a couple $100 at best and a few hours effort. Plus in both cases, all subsequent requests for assistance or access to their properties has been allowed with no fuss. It has really helped being on good terms with them both. I looked at it as they were there first so I gotta play nice. The concreter will take and reuse.
