Browse Forums Building A New House Re: Access to your building site. 22Jun 15, 2009 9:12 pm houseofl King willy People remember you have every right to access your site and do so in a safe environment. Sorry for the rant but the King has spoken. Regards to all KW........... Ah well, basically we are screwed and our house hasn't even started to be built - our site alone is a freak show just from the site works!!!!! On a serious note, our builder has told us that we will always have full access to our site and to our build. As he said, nobody knows our house better than us! JL You have an honest builder or at least one how knows you are entitled to access your site. Give him/her a pat on the back. Re: Access to your building site. 23Jun 15, 2009 9:33 pm We go to sign our contract with M3tricon tomorrow. I don't know if we are supposed to sign anything to say we can't go on site but I cannot imagine that my fiancé would accept that kind of clause. Our land is in a new estate and there is a lot going on but we go past every weekend to see what has changed. I can't imagine us staying away and speaking to someone today who has been waiting 2 months for 21 items to be sorted out before handover (PD built) has made me more determined to keep on top of what is going on!. Anyone here had any experience with M3tricon in Vic? Land: Titles 27/10/2009 - settled 9/11/2009 House Design: Talbot 28 (Contemporary Façade) Estimated move in date April 2010 ... ok maybe June 2010 with any luck Site Start 22/01/10 - 20/08/10 Handover!! Sandarra Facebook Group Re: Access to your building site. 24Jun 15, 2009 9:37 pm All builders have a clause where you sign over the control of the block to them, like it or not.. Some will even stop work on the site if you keep interrupting the works, and charge you for the delay.. KW......... You are spot on there - since we hit rock on our site last Thursday they have been jumping through hoops for us. I have enormous faith in them, one of the reasons I chose them was because of their honesty and integrity from the first meeting. JL Re: Access to your building site. 26Jun 15, 2009 10:06 pm Joles As I said it was an example not aimed at you personally and I did put myself in the example also, and I meant on site in front of our house. As you correctly point out the act is open as all are to interpritation, what is “reasonable”. My post was aimed at making people aware that they have legal rights. When builders put clauses in contracts and send out disclaimers to owners that contravene the DB Act, to protect themselves, that’s not fair. It’s not fair that people are lead to believe they can’t go into their own home to experience the enjoyment of their dream that they have paid for. I can’t see anything wrong with doing that. I honestly don't understand why you'd want to start a build with an "us against them" attitude towards your builder?? I was not the one who sent the letter telling me I can’t access my site, it was the builder. So I guess its “them against me” My post was asking has anyone else got one and I think the majority have said yes. I’m sorry Joles but price, flexibility, fantasy or control has nothing to do with site access as the Act applies to all Domestic Building Contracts in Victoria regardless of the price or who builds it. So too does the O, H & Safety Act. You are right I don’t want to antagonize my builder as he has a good reputation. I feel a lot of this comes from people having too much access and they are their every day telling the tradesmen and woman how to do their job. Never the less I will be discussing it with him some more. As you said most people go on site anyway after 5.00pm even after they sign a disclaimer not to. By the way Joles thanks for the reply as always I enjoy reading all your posts. Kind Regards KW……………. “It's just as unpleasant to get more than you bargain for as to get less” George Bernard Shaw. Re: Access to your building site. 27Jun 15, 2009 10:25 pm kbudgie Anyone here had any experience with M3tricon in Vic? Still waiting for council approval so not that much experience yet. So far they've been pretty good. They even told us: "Off the record, everybody knows you're going to go for a look on site every weekend. Just don't get yourself hurt because our endurance doesn't cover you" Trying this building gig one more time. Re: Access to your building site. 29Jun 15, 2009 11:31 pm joles Casa2 alk Coral give you a construction key, big ups to Coral I think its excellent customer service, a home is the most important purchase you will ever make. Now that's the sign of a good builder. (See the OH&S excuse does not hold water!) Or they just haven't been sued yet. I'm not saying it is correct, I'm just saying it's understandable. In a perfect world, all the builders would be like Coral. But if I ran a building company, in this day and age of people suing left, right and centre, I wouldn't run the risk. Hmm maybe but Coral is very legally concious. For example, they flat out refuse to pivot a front door since a child lost some fingers in a new house built by a different builder. You do sign an agreement for the construction key, you can use it but you don't go poking around while construction is on for safety reasons.
