Browse Forums Building A New House Re: Dispensation for setback - Monash City, Victoria 21Aug 15, 2009 10:56 pm congrats tc2000 !!! that's awesome to get dispensation ! yay i remember my friend have setback in monash city about almost full of their garage ! just wondering if those setback, allows you to put eaves included into the setback or does the setback needs to be the included into the design of the house? the reason i am asking if my land is in the corner with 2m setback. my design is already 14m, if i add eaves, that means it will fall into the setback. builders A said it's okay (because normal house have setback of 1.2m), builder B said you need to ask for dispensation. Although if you say you have a 2m set back - is that a side boundary of a corner lot? If so I would think you would struggle to get any sort of dispensation to eat into that. (you'll be on the footpath) Re: Dispensation for setback - Monash City, Victoria 23Aug 15, 2009 11:29 pm hi mudmap 2 m setback is to the boundary eg: my land is 16 m, so design maximum can go as far as 14m, that allows 2 meters to the side so if 14 m is wall to wall, then eaves will eat 450mm into the setback,which literally allows 1.55 setback to the side Final stage Re: Dispensation for setback - Monash City, Victoria 24Aug 18, 2009 1:57 am Hi d3p, Regulation 414 of the Building Regulations 2006 relates to side and rear sidebacks. If the height of your house (at any point) from natural ground level upwards is not more than 3.6m high, than the minimum setback from the side is 1m (the more you exceed 3.6m at any point on your site, the wider the side setback becomes). The more you exceed Eaves (not more than 600mm) are an allowable encroachment into the setback. You should check with your city council to see if the 1m side setback applies to corner sites like yours. If it's just the minimum 1m side setback you should be OK since your eaves are 450mm in total width and the Building Regulations allow 600mm encroachment into the side setback.... Hope this helps... Yup, I dug my heels in and researched the length and breadth of the WWW to find the correct wording to use in my dispensation letter. I also did the "forlorn" and "helpless" female act with the assistant building inspector to squeeze out from him as much advice as possible (to of course use in my letter). I was over at Town & Planning so many times that at one point, one of the guys behind the counter recognised me and than subsequently, another guy recognised me not because he had seen me before but because he had seen my floor plans a couple of times (when my hubby went down). So 5 pages worth of words, an aerial pic of my street (painstakingly created via google map and multiple prints), various recreations of neighbours setback to mine, and 2.5 weeks later, voila, Council gave its consent (despite and objection from one neighbour - about loss of sunlight to her verandah!). Well, it did help that we have the drainage easement and the angled frontage - which worked in our favour. I even went down to personally thank the assistant building inspector! Would have hugged him but I thought it would be too much..... Where abouts are you building? Hi tc2000, I know this is a really old thread, but we are also building in Monash and have just had our application for reduced setback declined. Can you offer any advice on wording, reasoning, approaching neighbours etc that might help us with an appeal?
