Hi all.
My hubby and I are building the M Newhaven 33. As an extra, we had the Alfresco added. Part of this extra, included Coloubond cladding in lieu of brickwork above the alfresco. It clearly states this in our contract.
We have been to the house, and they have used lightweight cladding.
We have looked at the plans, and they have lighweight cladding.
I wrote to our CSC, who has come back to me stating that they made an error in our contract, and it is supposed to be the cladding. The have had an estimator look at it, and the cladding is right.
I tend to disagree. I was under the impression that the contract, followed by the specifications then the plans took priority. As in, contract rules. What do you all think?
Another issue is something that I think I may have backed down on too easily. We paid our deposit in May last year, the day before price increases were coming into effect. Our consultant at the display told us that we had to pay it then to lock prices and inclusions in. So, we did. We were given information on tiles, bricks etc and started researching what we liked in preparation for our colour selection appointment in August. From the list we were given when we paid our deposit, we found a brick we loved, looked at about 10 or so houses built with it, and decided on that one. At our colour appointment, we were told that that one was no longer standard (it had changed a week or two prior) and if we wanted that brick it would be an additional cost. We had not looked at anything else, as we loved that one so much, so agreed to it. It has cost us an additional $2700. Again, I am just wanting to know what you think? Does the deposit in fact lock all prices and inclusions/specifications in?
I am prepared to fight these issues to the end, as we are the customer, and all too often these companies walk all over us. It has not been the best experience to date, and I'm damned if I am going to stop putting up a fight!
Any input you have would be greatly appreciated.
Thanks.
