Browse Forums Building A New House 1 May 04, 2009 8:25 pm For all those who have read our post.... we have had some trouble with our builder... i cant even begin to to explain how frustrated we are. Unfortunately it started at frame stage, their were a few issues that got resolved after many angry emails and a meeting with a few supervisors (that's right 3 of them - lucky for Big Kev ). Then we were harassed by our builders accounts payable lady because our base and frame hadn't been paid. this was because commonwealth bank was suffering from a huge back log before Easter and was out of our control! (not that i expected our builders to care) They were Horrible to us... threatening even! then the issues continued with all of our vanities installed even though we told them they were the wrong colour prior to the installation. *Bathroom *powder room *Ensuite *laundry Actually the only thing that was right was the kitchen. we got a call not last Thursday but the Thursday before from our our SS stating that the vanities and benches will be fixed in the next few days then painter were in 4 days time.... hmmmmmm (this was one issue of many including wrong colour downpipes ) well friday the 1st may we received the LOCKUP invoice... sunday the 3rd we went to have a look and the bricks were not finished????? Does this mean we dont pay lock up yet?? i sent the builders another email today outlining our concerns and so forth.... our crappy leaision lady said that the building supervisor would call me to discuss (no one called) Then i get home and the BUILDERS HAVE GIVEN US A FIXING INVOICE!! WHAT THE ???? Your thoughts??? am i over reacting?.... i just keep thinking about all the harassment we received about the late payments!! im really starting to hate the whole building thing - wouldn't recommend it to my worst enamy Carlisle Atlantique 32sq - Handover 13th Aug... I am feeling angry at just reading your post. I wish I could offer some legal advice, but am building a first home so I hope my well-wishes are enough for now. Stick to your guns and dont pay a cent until they fix their mistakes up. It's your money mate! We also are building at the moment and we too got our fix out under, off, over, up, down, whatevers its called invoice today and it's clearly not at this stage. From what I've been able to glean the supervisor is the one who puts in the invoices. He/she does this at the beginning, based on a calculation of weeks it will take to get to each stage. If however delays occur along the way, then the supervisor needs to advise accounts to hold off on sending. However they forget or think it might only be a matter of days so leave it. Yours however sounds like a right royal stuff up. I would ring their accountant and have a polite coversation with them. On these occasions we emailed them telling them to adjust the due date to be 14 days from the actual completion date - which in each case was a few days or a week later I think. We didn't have any problems with this, given they clearly didn't have a case to argue. Sorry to hear your build has had so many problems. Perhaps we have your downpipes - ours are wrong colour too! Do not call, email first then follow up with a call. This happened to us too and we're building with PD. We got the lock up invoice and emailed accounts letting them know what had not been completed to that stage. I emailed the next week detailing the outstanding issues. We paid it two weeks later once the last things were fixed. Three days later the fix invoice arrived. That was nearly four weeks ago. I still have not paid that as the stage is not completed. I emailed them immediately telling them it was not finished and listing all the issues I could see. I still email the accounts lady each week with an update to let her know where it is at, in my opinion. She can then follow it up with the SS. I must say, through, she has been great to deal with. They do have a set idea of when things are "supposed" to be finished and work off that. I just keep her in the loop and I CC my CSC too in a weekly email. Remember, based upon my understanding, when you pay a stage invoice, you are accepting the work that has been done has fulfilled all the requirements of that stage in your contract. If you pay Lock up and the bricking is not finished and the builder goes bust, I believe that means you cannot claim any costs for completing the stage because you accepted it as at "lock up".
