Browse Forums Building A New House 1 Apr 20, 2009 10:04 pm Our builder has just changed it's processes and is now getting customers to sign the building contract/agreement prior to council submission as opposed to after. As we are currently in council I am having the contract sent to me to go through with my solicitor before we sign it (perhaps next week sometime). Now I am of the understanding that once we sign this contract the price is locked in subject to council conditions and any provisional costs (our only provisional is for rock). However someone told me tonight (they used to work for one of the big volume builders here in Sydney) that even after customers signed the contract that until construction actually began the builder can still increase the price. This astounded me. Is this really the case??? What am I signing if not a fixed price agreement?? Confused once again...... Re: Signing the contract - does it lock in the price? 2Apr 21, 2009 9:47 am My understanding is that they can only increase the price (other than upgrades you choose at selections) if there is unforeseen circumstance affecting the price to them for example sudden increase in cost of raw material and they have to show that this increase was unforeseeable. Not sure how often this happens , in our case nothing did increase from their end after the contract was signed (we had fixed footing costs). Thank you so much everyone.
