One of our estate guidlines (Cascades on Clyde) states that we need to have Telstra Smart Wiring. PD has noted under the estate covenant section of our contract: 1. Additional costs due to estate covenant requirements include the following items: - Provide tapping & connections for recycled water to 2No. toilets and 1No. external garden tap. - Telstra Smart Wiring (Under Electrical Variations) And in the cost column it states Included. However in the Electrical Variation section of the contract it notes that: 2. Provide Electrical items as per the Argus Technologies Quote dated 17th March 2009. Note: Smart Wiring Package required as per Developer requirements. (And in the price column it is charging us $2,300) What's going on? Am i being taken for some kind of idiot? Should this be included in our fixed site costs at no extra cost to us? I have emailed my CSC.. I am hoping it's a mistake and we'll be reimbursed the $2,300. From what you have written, it looks like it wasn't included in the fixed price offered as it sounds like they needed to get a specific quote done for it - did they warn you about this? Thus the costs do rise until contract and then its fixed. I'd try and argue it tho.. No, that's not right - I've been through the contract and my house was fixed price with site costs and then anything I added on top and the up front fixed prices included the estate covenants and they should be able to give you the list of these. Yes I'm still paying for them, but they were included in the fixed price given from PD for that block in that estate before even paying my initial $1k deposit. Estate covenant charges are separate. If you have purchased a House and land package through PD then the quote given to you inititally should have included estate covenant charges in the total amount however they will be itemised on your contract as you have to pay for them. Were the estate convenant charges included in your original quote ? We were told by PD at our initial sales quotation that all estate covernants are part of the fixed site costs. In our sales quation it lists estate covernants and it has a figure of just less then $5k next to it which is making up the costs we payed to have our site costs fixed. I got an email back from our CSC stating: "You have not been charged for the Smart wiring in the Estate Covenant Requirements section. As you can see next to the item is states (Under Electrical Variations). You would be charged the same amount regardless of which section it is under. This means that it is an Estate Covenant Requirements however we have charged you for it under Electrical Variations. This is done due to how we order trades and materials for your home. Although it is an Estate Covenant Requirement if you are not happy with our price you can have it done yourself after handover. If you want to take it out you will need to let me know now as I am going to do the final listings for your job this morning." In our final quote and also our contract we had site costs and estate covenant additional costs as separate items. Land Settled 27/04/09. Site Started 30/4/09. Slab poured 21/5/09. Frame up 27/5/09. It's all good and well for them to say that you would have been charged it regardless, but that would have changed the upfront knowledge of the price of the fixed price house! This is what bugs me about it is that fixed price is meant to be that, you should then only have to pay for upgrades that you choose to have - if you are borderline with what you have budgeted for it could mean that you can't do certain upgrades as you thought it had already been covered off in the price given in your sales quote 'A bottle of wine contains more philosophy than all the books in the world.' There's usually a whole lot of ** with footnotes listing conditions and exclusions at the bottom of the advertised offers. When i thought they'd made a mistake with the fixed site costs in the contract because it was $2,300 less then i was quoted, it turns out that's actually the smart wiring and it's just shown in a different section. So it is included as part of the fixed site costs.. it's just in a different spot to confuse me!!
