This is my first post to the forum. i have been reading for a few weeks now. We are in stage 11 and are still angry about recently recieving the letter of the next delay to title being March. We bought under the impression that it would title in January as a worst case scenario. then February, which made us grit our teeth a bit but was still possbily going to be ok, yet cutting it fine. Back in July, we organised building to begin in March, thinking we'd be allowing at least a 2 month window for any delays. so obviously now with the possibility of titles not being released until march..we are very stressed out! i am sure there are many other stage 11'ers out there that are experiencing the anxiety ansd stress that we are now. and im sure theres some of you who organised for building to begin much earlier! i rang the number on the letter and spoke to the guy. he was useless and couldn't really care less. I am planning to ring him every week to put the pressure on. they are leaving a really bad impression on clients and dont seem to care about the enormity of the ramifications of delaying construction. if everyone in stage 11 could start ringing and aksing for answers or time frames it might show that we mean business. i get the feeling that back in July they knew full well that there was no way they'd have finished construction when they said they would. Is this a Consumer affairs case, or are they covered somewhere along the line. if it gets to the point where our building obviously cannot begin in March we will start copping a weekly fee from our builder, then after a certain period of time we'll be on the next build start in August and copped a $3000+fee. i'll be sending these invoices to Villawood for payment. although our conveyancer is currently looking over our contract to see if theres a clause that's going to cover their a$$es at every avenue. not to mention the extra effort we'll require to get the FHO bonus/boost. sorry this is just a bit of a rant. Needed to vent a bit. looking forward to a next post with hopefully some more positive news. I am pretty sure that you will find that Villawood have covered themselves in regards to delays in title. Off the top of my head I think the contract says that they have up to 2 years to title the block? They will not be responsible if you signed up with a builder in the meantime expecting that the land would title when they told you it would (why shouldn't it be when they told you it would?!) As with the FHOG, you can apply for extenuating circumstances if your land is titled late. See earlier in this thread for more info. Unfortunately a large majority of developers do not give true dates as to when they expect the land to be titled. Not sure if they know at that stage that the date is not realistic or not, but that is just the way it is. This is not just a Villawood issue. Thanks for your reply sarahq. the FHOG info is some comfort. its just the snowball effect of building being delayed (possibly), start date being moved, having to change plans further down the year i.e. planning a wedding, etc etc. theres just too many possibles and not enough definites at this stage. at least come January/february we might have a better idea of whats going on and deal with things as they arise. Just got to get past the fumings and be positive that everything will fall in to place nicely.. good luck with the rest of your building. sounds like you are getting great customer service from your builder. that makes things so much easier!
