Browse Forums Building A New House 1 Mar 26, 2009 11:17 pm I didn't get Handover today, and my lease is up this Wednesday, so I need to move this weekend. Tomorrow I will have to beg the Real estate and see if anyone has taken a lease on this place, if someone has I don't know what else I can do, but move into the new place without an official handover. Does anyone know what the consequence of this would be? The rental we're in just sold yesterday, so we're hoping nothing slows down with our build. Re: Moving in without Handover 4Mar 27, 2009 12:31 am Personally, I would not do it. We moved into our current house because we had two small children and were being kicked out of our rental. Builder promised to fix everything after handover. They went bust less than two weeks later and we had to fight HOW for three years to try to get stuff fixed. There are still things that were never fixed and some we had to pay for again to get fixed. From what I understand, they don't give you the keys until handover... its not your property until then. We kicked them out on the monday and were then constantly watching to make sure they didn't move back in. No Occupancy Permit had been issued & they hadn't paid their final invoice, harsh but as per every contract states, it's the builders property until OP & paid..... I don't think I'd like to risk moving in illegaly, but telling the builder of your situation may make them hurry it up as well. Like others have suggested you can have your gear in storage, removal companies will hold it for up to a couple of weeks without extra charge I believe (assuming you weren't looking to do the moving yourself?). Only hassle is the expense of staying somewhere else temporarily, do check out cabins and the like in caravan parks, ask if they have a cheaper rate for longer stays (like a week plus). Hope it all works out for you. This certainly doesn't look good. I would be engaging with an independent inspector to have a look at this.
