Our tender (201 days) expires at the beginning of June and we know for sure that we will not have signed the contract before then and there has been 1 price rise on the base cost of our house and likely to be another one soon. So my question is did you go over your tender period and did your builder put your price up - even if the reason for going over your tender was no fault of your own? Can you negotiate? Our builder told us that if the delay is due to them, or the council, the price rise wouldnt take effect. They said it was only if we delayed the process either by the bank ,or us taking too long to decide, or get all the info to them. They said its more to protect themselves from people dragging out the process for months and months and them losing money because the cost of supplies have gone up when they gave you a fixed price 8 months ago ( for example) They said even if council took 5 months that we wouldnt be liable to pay a rise if any. And stated i did not want to start the whole process of buliding until early 09. JG king told me that deposit would lock in my price till 2 price rises. Since then they have have had 2 price rises and have still stuck to our agreement even though they probably didn't have to. I just made sure that i got our agreement in writing. I have now signed contacts in Jan 09 and saved over $20,000. I would negotiate with them and get it in writing as it is no fault of yours. Hopefully they will be considerate to you. We signed our tender however our land title got delayed by 5 months after that. Hence during the contract we were charged the increase. Also another thing that changed from Tender was cost of downlights - noew being 'fire rated' (read more expensive) as per govt regulations. we had to bear cost for rise. Thanks I think if it's not your fault then you can negotiate. A lot of builders will review but will not rise the full amount of price. For example, the standard price rise $3K but you'll only get $1K rise. Some builders do not charge at all. It depends. Please update us the result when you do it in June. Re: Did you go over tender and incur a price rise? 6Apr 20, 2009 5:12 pm We went through tender after tender, basically because they couldn't get it right Our 3rd tender dated 14May07 was valid till 22Sep07 (we did have a $4k price rise between 1st tender 22Jan and 3rd one 14May which we accepted as it was us taking our time deciding at that point...) as we neared that date, there was no way we'd make it into/out of council for 22Sep07...(and we signed to contract to build on 27June07) We got a variation from C advising us that they'd extend the building agreement to 22Dec07 (we were still in council at this point). They then gave us till 31Jan08... still no where near ready for start on their part..
