Home Warranty Insurance is mandatory, it does differ in each state as to how it works. You must receive a copy of the insurance from the builder, it will detail who the insurance company is. They have to take it out on your behalf, it is not something you have to organise. If they don't give you a copy of it, then ask them for one, this is most important. If anything goes wrong you don't want to find out the hard way that they didn't take the insurance out. Also they normally have some type of construction insurance that covers them for liablity etc. Hope this is of some help. Also from what I was told, the owners were responsible for paying for it. But our scheme down here was a bit iffy - we had a big political hoo-haa over this whole scheme (several politicians lost jobs). Don't assume they have taken it out, make sure you get a copy of the certificate. If you take a look at the website for either of these two insurance companies, Vero or Lumley (I think they are two of the biggest) they will have all the details about this insurance including what it covers. It only covers you if the builder becomes insolvent, dies or disappears. You can't take out this insurance yourself, the builder has to (unless you are an owner builder). Hope this helps.
