The house sits about 3 m away from the side boundary, the distance where we would like to rebuild again. I look now at our setbacks for this zoning and it says we have to build 7.5m away from side, i guess when this house was built in teh 60's they had different setbacks. The land is being used for a business as well, so moving our home a few more metres away would mean building where the land drops off as it is higher where we are and choosing a narrow design or we end up in existing next door driveway. I rang and said how impracticable it would be to build 7.5m away, they said we could get a planner to come out, for $550 for half hour visit, what will that achieve? Whats even more annoying is the council sent out a letter last year saying they are changing the zoning to residential, which would allow us to build 2.5m away, but now with the change of government this is on hold again and not happening for a while, so basically we build 7m away and it could change after we have already built it Re: So annoyed with council 2Mar 18, 2009 11:53 am You can apply for a relaxation of the setback. You would have to put together a report stating your case or hire a certifier to do it.

Can u tell me about the certifier or how i go about it all please? We also have to build 20m back from front boundary, this i don't mind so much but 7.5m away from side is a bit silly! This will at least give you the bit of knowledge you will require to find your self a certifier if you dont want to go at it yourself.
We paid around $400 to council in fee's and about $150 for our certifier to do up the report and submit for us. Our certifier did a 4 page report and did all the running around so i think that it is money well spent. We have applied for a reduced front setback, zero boundary garage and our footprint is over the 50% accepted by our council so we are asking alot. We've got everything crossed at the moment and hoping to hear back this week. A certifier is essentially someone who oversee's the whole building process to ensure the house is going to be (and is) built to the standards and guidelines imposed by the local government, council and Building Code. They basically do what the council used to, assess and approve. Maybe just give a town planner and also a certifier a call and see who seems the most cost effective and easiest to deal with.
