HELP 42Mar 13, 2009 4:48 pm soda thank you zeke, the never ending loop of responses started giving me headaches. And the jokingly gesture bottle of scotch had very real legal implications. It was an agreement, and this very simple agreement prevents the benefitting neighbour ever making a formal claim for the small piece of land they occupy. You're welcome I hadn't thought of the legal aspect you mention, but I can see the validity. Anyway, it was never going to be a legal issue in this particular case. I've seen 1 neighbour call the police and attempt to have the other neighbour prosecuted for weeding the fenceline (stealing). 'They were weeds' the police perspective; 'But they were my weeds!' the unreasonable neighbours reply. Needless to say it went no further. The whole matter developed because of a fenceline dispute.

I just bought a house/land developed & build in 1978. Yet to move in. I want to replace the a current side fence with a taller one and extend it all the way to my legal front boundary to meet a new front fence. I am end block in a cul de sac. Q> Should there be old survey pegs somewhere in the ground? to find where front boundary meets boundary of proposed side fence. Q> If so what will the peg look like? Could it be buried ? Q> If not is it possible to find that corner of the block by measuring in from the roadway ? value of land / total sqm2 = value per sqm2 0.02 (20mm) X depth of land = amount lost amount lost x value per sqm2 = total amount owed. If it happend on my land I would have lost around $650.. I work at a large trauma hospital, and recently saw a parent go through the grief of seeing her toddler die due to a play accident. I think sometimes we lose sight of the bigger picture. Fair enough, its 'your land' and 20mm is 20mm, but isnt there much bigger things to get your knickers in a knot about. HELP 50Mar 14, 2009 4:53 pm Ok, a little off topic, but a bit of advice from someone who deals with clients building daily.......(i know you have mentioned you are ok with it now but if some people get stressed about 2cm, you will be incredibly stressed during construction) when it actually comes to building you are going to find things that are wrong on site, not finished to your requirements etc etc etc. PLEASE RELAX (this goes to everyone building). If you have it in your contract or variation it will be fixed and you do get the opportunity towards the end of the build to make your supervisor aware of things you would like rectified.
And I can say I know what I'm talking about.....we are buidling at the moment and in some spots the painting isn't quite finished to what I expect, there are dints in a few spots & handles where there shouldn't be in the kitchen. Interesting reading this about the fence on the wrong side......I just had the surveyor out today to tell me that my fence is inside my boundary by 900mm. So, my neighbors pool filter, pavers, deck, etc is all on my land. My question is, what can I now do and over what time period does my neighbor have to move all that stuff??
