I have a dilema which maybe somebody could help with some advice. For the past 4 months a really tatty small van has been parked outside my lot. As it didn't have number plates, I reported it to the council who then put a 'possible abandoned vehicle, claim ownership' sticker on it. Today I noticed that it now has a rear number plate and has been cleaned up but not moved from in front of my lot. As my builder will wan't to start soon: 1. Does anyone think it will impede the build? (My lot it 19m wide and the van is only probably 3-4 metres long) 2. As no neighbours claim ownership, what can I do to have it moved legally. 3. If the owner does turn up an refuse to move it, what can I do? Note: My lot is in an estate with no apparent parking restrictions. “Move it please, as building will be commencing soon and you will not take responsibility for what could happen to it through this time.” If that doesn’t work call the police, its parked illegally on private property! I bet if the police come they might have reason to stick a few “Pink Slips” on it by the sounds of things. Looking at the state of the van,,,,it appears to be a tradie's 15 yr old van and has plenty of knocks/rust on it already (hence appearing to be an abandoned vehicle) As for being parked illegally...technically its not...its parked on the road infront of my lot..not on it. But while it looks like the block is vacant they are using it to their advantage…… A bit like me with the block next door, been there for 20 years, no one built or did a thing to it. So I used dump my 2 tone of soil on it and wheelbarrow it to me place when I needed it. The Guy next door on the other side used to dump all his wood for the winter on it. So we are pretty much at fault also. The block has finally been sold…..boohooo, neighbours after ALL this time. Now I’m panicking that my trees are too close to their boundary. Time will tell, I’d hate to have to cut them down.. I think you will be ok, he’s just taking advantage of a good thing while he has it. He is entitled to park there.
If you damage the van, it will be your responsibility, so be careful. If not rego'd, the councils have standard procedures, eg "Abandoned Vehicles Definition Council aims to clear the streets of vehicles that: Present a danger to residents or motorist Are unregistered Are unsafe Are deemed to be abandoned The Local Government Act 1989 - Schedule 11 cl. 3. 33/1995 s. 11(c) (d)., states that “Council has the power to remove any unregistered vehicle or vehicle that has been deemed abandoned.” Procedure When an abondoned vehicle is reported to Council, an officer will inspect the vehicle and determined if the vehicle is in fact abandoned. If the officer suspects that the vehicle is in fact abandoned, a notice will be placed on the windscreen and a full report will be completed. In order to ascertain the identity of the vehicle's last known owner, the registration details will be sent to VicRoads or the equivilent department in another state. A response from Vic Roads can take 1 to 2 days, whereas a response from interstate can take as long as 3 weeks. The matter will be closed if: The vehicle is registered, has not been stolen, is not posing a danger and is legally parked. If the vehicle is unregistered, or considered abandoned, then a registered letter will be forwarded to the last known registered owner requesting that they contact Council or remove the vehicle within 7 days. If no contact has been made, an officer will conduct a second inspection. If the vehicle is still there it will be towed and auctioned to the general public within 28 days. For further information please contact Local Laws Department on 9278 4888" Check for a current rego label. If there isn't one, it is likely to be unrego'ed and the council can get rid of it, in time. Re: vehicle parked infront of my lot 7Mar 10, 2007 9:44 pm We had this problem with a van that was parked in the corner of the intersection that was the entrance to our court. And because it was a van it would block the view of any traffic coming from one side. Quite dangerous at times because some people like to enter the court at any speed they like. There's been a few close calls.
Anyway, we (all the people living at my house) were getting quite annoyed at it but didn't think there was anything we could do about it. It was parked on the nature strip and belonged to the owners of the house on that corner of the intersection. It had been left unmoved for so long that you could see the grass underneath was growing so long that it started to peek up from under the van. One day I came home and saw that the van had this fluoro coloured sticker on it's windshield. The next day it had been moved. To their driveway. For a few days we were happy that the van was removed and we could actually see any oncoming traffic. But before you knew it, they just parked another car there. The owners have a ridiculous amount of cars. Maybe 4 or 5 in total? And their driveway is only wide enough to park 1 car. I don't believe that they actually use their garage. My point, I guess, is that once you report it to the council they will start the motion. I think it might just take a few days/weeks after your initial complaint before it has to be moved or something. So, the other posters are giving you the right information. Might just take some time.
