We selected a floor tile to go in all wet areas, we were then advised the tile was discontinued and were sent 3 other similar tiles to pick from. We picked a new tile and informed the CSR via phone & email as instructed. Now we discover they have laid the original tile we were told was discontinued. The problem is we have chosen carpet, floorboards and other accessories based on the new tile we were told to select. Also, at no point were we told the original tile selected had become available. Obviously there is a communication issue between builder and tile provider - They have refused to rip them down as tiling is complete... Any thoughts?? Thanks. If you had to sign any paper work at all you should have your own copy use this if not i'm unsure of the legal side of things. They signed a requested variation for new tile, and then they laid the discontinued tile. I argued that they had signed the variation, they agreed, but then they said they signed it on the basis of the discontinuation.. But they signed the document, on a basis of who knows what.. They signed it and we signed it - done. I had a long talk with managers and FINALLY got my way. \ The thing is that if they have signed a document, if you dont have this, you should have written evidence that they agreed.
