Browse Forums Building A New House 1 Feb 23, 2009 7:04 pm Hi everybody. Our land has not yet been settled (so not yet titled). We are pushing for the soil test with the builder which is supposed to be part of pre-construction works. We wanted this before we sign the contract because of unexpected cost that might arise from poor soil type. However, we were told that soil test can only be done once the land has been titled.
Per our last visit to the land it is already levelled although still without a boundary pegs. It is also a corner lot. I think I read somewhere in another thread that soil test can be conducted despite not yet titled. Can I have your opinion on this? I hope to get some authority or rules to back up my contention. Do you know one? Thank you. The builder would have done the soil test even earlier, but the contractors building the subdivision wouldn't allow access to the site.
If you don't have boundary pegs yet, mistakes could be made in identifying the land, so I doubt anyone would be prepared to do the tests until that's sorted. There could also be an issue with the developer - they may not want builders in there at this stage. To clarify the boundary pegs not yet installed are on our right side abutting the street corner. Since we are just on the corner lot it is identifiable. And the roads are already open. Based on your comment I think I have to talk our developer if they will allow it. The soil tests were done early November and our land wasn' t titled until Late Dec so it definetly can be done. The builders weren't supposed to access the land beforehand but we had a clause in the land sale contract subject to site costs not exceeding $20k so the developers pretty much had to agree. We have had a second soil test done since though now the land is titled and prepared. Thanks for your reply. I will just wait and see I guess.
