If you haven't signed your building contract yet for Hen3ey make sure that you negotiate the Agreed Damages for late completion of work before you do. We're just coming to the end of their contract date and the house isn't ready yet. They've told us it is too late to negotiate the amount due to us (silly us for not asking before and they aren't going to tell you either). Sorry they havent completed yet flew, that sucks. Re: Agreed Damages for late completion of work - Hen3ey - note 3Feb 21, 2009 3:59 pm It states in our contract in Notes Re Clause 40 that the amount is negotiable and should reflect the owners estimated expenses. Thanks for the flew, i'll definately be checking my contract and be ready to negotiate if its available to me.

Also, we know there are a lot of things we need repaired which could take some time to be done before we settle.
Good luck if you can negotiate the cost. It would be great to think I've managed to stop someone else from making the same mistake we did. We only have 38 clauses... Our contract is the standard HIA 'Plain Language Building Contract for New Homes' and I can't see anything about payments if they go beyond the end of the contract. Anyone on the same contract and know if this is applicable? Cheers..
