Has anyone had to do this? and if so, How did you go about it? Basically you'll be in default and you'll be paying interest daily no matter what. The difference is that if you work out an extension period with them, then they'll hold off on suing you.
We were very close to having to go the extension route and Landcom was quite happy for us to do so but yes, interest was applicable if we went over (which luckily we didn't). I think the interest we were being charged ended up being something along the lines of $180 per day if I remember correctly. What does the builder have to do with the purchase of your land? You can settle on land without a building contract. Our conveyancerwent to the land office on our behalf and organised it all without penalties apparently you can be penalised for not settling on time depended on your developer! Speak to your conveyancer Yep, it all does depend on the developer. As nice as the legal people were at Landcom, apparently they couldn't do anything about the penalties for us. Make sure the extension you ask for is as long as you need as second time around they won't be as forgiving!
