I would just like to ask whether a council easement (drainage, sewerage) on your property (e.g. 3m of your backyard) totally prohibited you from putting any construction on it? Such as paving it or putting shed. Thanks. Re: easement over the property 2Feb 14, 2009 9:01 am Depends on what the easement is for and what you want to put over it. In our case we had one easement through the centre of our land that could only be built up to 1m to it - not directly over it. That is a structure - we could put paving over it however if the easement was ever needed to be accessed they would destroy whatever was on top and we would be out of pocket. Needless to say we had that easement extinguished as it was only a proposed line that was never utilised.
We also have a 5m wide easement along one side of our block - something to do with the drain beside us. We have planned the house so that is the "dead" side of it and will use it as a driveway area - but again should the Council need to destroy it we have to grin and bear it. Some things are worth waiting for. Re: easement over the property 3Feb 14, 2009 9:14 am My son has a drainage easement for Yarra Valley Water along side his property. It's about 1/4 acre strip down the side of his property. Initially YVW would uproot trees he planted and would not let him fence it in. That caused problems because people would use it as a shortcut, making litter etc.. He spoke with them and now pays a peppercorn rent to YVW, and it's fenced in just like the rest of his garden. Though he can't build on it.

Both our previous property and our current one have sewer easements along the rear boundary.
We put up a small colorbond shed, about 2m x 3m at our old place, complete with concrete slab, with the knowledge that if Melbourne Water needed to access the sewer, the shed could be unbolted from the slab and removed (although the slab would be destroyed, of course). We built a much bigger shed as well, but located it just clear of the easement, as we definitely didn't want that one demolished. Planting of trees and shrubs was never an issue. On our current property, we plan to build a 2m x 5m pergola at the back of the house, which will extend over part of the easement. Under normal circumstances we wouldn't need a permit for an unroofed structure of that size, but because it's over the easement, we'll have to apply for one. It should be just a formality, we don't expect any dramas. Re: easement over the property 8Feb 15, 2009 2:32 pm We applied to City West Water to build a retaining wall on our easement and it wasn't a problem. We eventually plan to pave there as well. It does say in the documentation though that they can move/destroy any approved structure to access their easement. So saying that do you think it makes any difference if you apply or not?
