We signed in April 08 with them and now after colour selections 6 weeks ago they will release us to construction ONLY if we agree to part with an extra $3000 to cover rise and fall. They knew about this at colour selection but let us shop with our colour consultant and spend away. Has anyone else had this ransom put on their home just 2 days before start date. Its not the money its the ** and underhanded way they have gone about it, had we known 3 months ago when they put their prices up we WOULD have gone to another builder but now we have resigned our rental lease and need to be in in 9 months. I have had a similar experience. Council has been waiting on a couple of minor details for nearly 3 weeks from the building company I am with, and now I am being told if we are not on-site by the end of the week they want to bump the price up in line with the new price list. But how can they charge extra after you have expended so much time and energy in the deal? $3,000 for rise and fall - I don't think they need any extra for a "fall".

Is there anything in there says you must pay an upfront fee? If not then refuse to pay and tell them you will charge them for the time you have invested to date. Thankyou for your advice hopefully this will set us up stronger for all the dramas we may well have during the building phase. When we did the quote for the house we had A/C and Flooring on there, we ask if they could be removed before for we signed as i worked out alot cheap to get it done after. We were told not to worry its a P.C. item and that it would be taken off at colour selection. At colour selection we took it of about $25000 worth and add about $5000. So we comitted to and signed final costing about $182K. They poured our footing (which they stuffed up another story) and sent us the the payment which is 30% of the cost of the house. We got a shock when we saw our payment was based on 30% of $195k. So again we rang up and sayed our final cost were $182k not $195, according to them the payments are based on the original cost not the final cost (go figure) and it is all written in our contract, in which we looked up and couldn't find. So here is a tip do not add anything on before you sign the original contract if you don't have too or you will be paying the builder extra money. Have a good read of your contract. They maybe just trying it on. Im no expert but I think in the standard HIA contract it states that if building is delayed by more than 6 months from signing, you may be up for a price increase or price review. Im currently going over this with my solicitor & builder. I dont know if this is your case ( starting the 6 month after signing) But it is I beleive only if the delay is somthing in your control ie planning permit, titles not ready, not the builders fault or in there control. Its in the contract. May I ask if you dont mind before you signed did you take the contract to a solicitor? I would like to know as I feel most people dont feel it is nessesary, was this the case with you? I hope you can get it worked out & you are happy with your new home.
