Re: land settlement 2Feb 04, 2009 3:37 pm We used a conveyers and they organised everything for us, the bank to come to settlement, the formalities with the land office, and how money was to be allocated, all we need to do was send copies of the land contract and tell them who our loan was with and of course have our loan in order ie- ready to settle, fully approved waiting for settlement type of thing, and they did all the rest!
They told us the time on the date and called us an hr late to say its all yours! easy!! Louis Pasteur Vegie garden: viewtopic.php?f=19&t=27637&start=0 My Backyard Adventure Re: land settlement 5Feb 04, 2009 10:33 pm cococrunch you definitley need to find a solicitor to act for you in the purchase (for both the land & the building if it is a package) the conveyancer will do the appropriate searches on the land (floods, mining, main roads)/, will check for land tax, organise for any mortgage over the property to be discharged & will prepare a transfer of land (so that the land can be transferred into you name ) The conveyancer will liase with the vendors solicitor, your finance institution and will attend the settlement on your behalf. You don't HAVE to hire someone to do the work for you - everything that they can do, you can do too. You can even buy a kit with all the info and forms you need. But unless you know what you're doing, I don't recommend DIY conveyancing. I did ours when we bought our first home and it was easy-peasy. Ended up costing us less than $100. But then, I worked for a bank and knew about property conveyancing, plus I had access to all kinds of info that most people don't. MInd you, I also DIY-ed probate on a will once, that was fun.... I like to try everything once. Second time around, I simply didn't have the time, and I've been out of the banking/lending biz for quite a few years now and things change.... So with both selling and buying to take care of, we decided to just spend the $$ and let someone else worry about it. Just take whatever papers you have to a conveyancing service (cheaper than a solicitor) and they'll take care of it for you. You might want a solicitor if you think you need legal advice re your contracts - most conveyancers can recommend someone. In which case, you need to have an assigned Solicitor or Conveyancer defined within those 3 days. My contract is pretty good, my first deposit was $500.00, and if finance didn't go through, I receive that $500.00 back. So it's a no lose situation for me. Yeah I don't know why I came to a forum.
