Would anyone here say that all the external Cladding is complete on my house? I sent Coral Homes the letter below, their response was to call my wife, who told them that they needed to deal with me, and told her that they have completed to 'Enclosed Stage' and that I am not allowed to with hold payment from them. Just for the record, my contract reads word for word - "Enclosed Stage" for a building means the stage when: (a) the external wall cladding is fixed; ....................... ....................... What do you all think I should do next? To Coral Homes, Yesterday I received a letter dated 17/12/2008 stating that our home has progressed to the enclosed stage and to give notice that the works have been completed as per schedule 2 of our contract, and that payment is now due within 7 days. I visited the site earlier today, Friday the 19th December, and noticed that the external wall cladding is not completed, as the Fibre cement infill panels above the windows and door openings have not yet been fixed. Therefore I will not be making this payment until all of works detailed in my contract under Schedule 2 - Enclosed Stage are completed, and I am sent a new letter stating that these works have been completed. Cost wise the cement sheet etc is nothing in comparison to the hole thing.
You may be within your rights however I wouldnt be trying to get off side with him. Instead i would be saying that you have noticed these things are not complete yet. But given they are small items you are wiling to make the next payment in good faith. Re: Enclosed stage problem with Coral Homes 3Jan 06, 2009 10:27 pm Yes, I think I agree with Borg. I'd prefer to acquiesce where possible but be ready to stand my ground on the important issues. Sort of saving the ammunition until it's really needed.
Also, I noticed on your blog that the internal plasterboard walls are almost complete......did they need to do this prior to the "enclosed" stage? Maybe a case for "give and take"? But that's just my opinion.....I can't really disagree with the stance you've taken. My advise to others, even if your builder has done work that is not yet required for the stage they are at (i.e. Plaster), Do not pay them until they have done what is required for the current stage. Just for the record, this had nothing to do with money, but in my experience you really have to treat building you house like a business, I can see that most would not like to cause trouble for a minor issue. But if you can show that you won't give an inch on a minor issue, hopefully they won't try anything on you that could turn into a major issue. Re: Enclosed stage problem with Coral Homes 6Jan 07, 2009 9:16 pm Well, if I get a progress payment request and the work is 95%+ complete and other work well in excess of the deficiency has been done (as in the internal plastering in your case) I'll happily pay it on the spot, because it seems fair and reasonable to me.
You mention treating building as a business. Well, my only occupation at present is running several successful family businesses and that's the way I choose to do things. A business-like approach does not depend on being pedantic. I believe most of the people I deal with appreciate a degree of flexibility......especially when it's "no skin off my nose" as I think applies in this case. Anyway, that's just my point of view. Sometimes easements are unused and 24cm is not all that much. Good luck.
