Re: "Mark & Melissa's Build Blog" 5Dec 23, 2008 10:59 pm I think you'll find that plan is barking the wrong way up the copyright tree.
The '10 percent' changes is not only a myth, it's complete B*&LS#*T! The builder is question probably won't care though, and that's probably NOT a good thing... Re: "Mark & Melissa's Build Blog" 6Jan 10, 2009 8:36 pm If you copy a plan in any way it is breach of copyright - you can be sued and it could cost you $50,000... it has happened to famous companies - ask M...con, Clarendon, Sim..ds, Marshall Baker...
Do not copy anything. You can look at lots of plans and draw yours up independently... DO NOT COPY - DO NOT SAY YOU HAVE COPIED ANY PART... $50,000 Call this thread - "Go to Jail" Oh and they do sue ordinary people to - that's where I got the $50,000 figure. The others pay millions... The companies above were sued... by other companies... and they lost big... Re: "Mark & Melissa's Build Blog" 7Jan 10, 2009 8:38 pm he's worked it all out, thats why we are puting the thread back up. ive done some checking with my solicitor and he concurs with your comments so im waiting to hear from Coral how I go about buying the plan to keep it all legal my solicitor advised that the builder wont get sued at all, it will only be me, so thats not the path i want to run thanks for jumping on it though, im not really a fan of getting sued Blog - http://snakedr.blogspot.com/ Build Thread - viewtopic.php?f=31&t=12084&p=307406#p307406 Status - PCI 15/10. Re: "Mark & Melissa's Build Blog" 11Jan 10, 2009 8:45 pm I doubt if Coral will sell you the plan...
If you came up with the exact same plan as Coral by coincidence - they can't sue you... Judge Finkelstein more or less said that in the Clarendon case when Henley sued them a few years back... but they had copied the plans, taken photographs... and it was all shown in court. Re: "Mark & Melissa's Build Blog" 13Jan 10, 2009 9:10 pm what constitutes copying then if they wont sell me the full floor plan?
at this stage we've been going off the layout in the sales brochure Blog - http://snakedr.blogspot.com/ Build Thread - viewtopic.php?f=31&t=12084&p=307406#p307406 Status - PCI 15/10. Re: "Mark & Melissa's Build Blog" 15Jan 10, 2009 11:01 pm billdsl what constitutes copying then if they wont sell me the full floor plan? at this stage we've been going off the layout in the sales brochure Saying you copied it is a big problem... You can look at heaps of plans, you can look at heaps of houses, you can draw up a plan later and it may resemble some house or other... but you didn't copy it... so you are OK. Look, don't copy... 10% rule is a myth... a copy is a copy even if you change 99%. Just look, think, draw. Then it cannot be a copy. And good luck... sorry for being a pain about it. You can have what you want if you do it right. Ed Re: "Mark & Melissa's Build Blog" 16Jan 11, 2009 12:31 am I'd suggest you just draw up plans for a house you would like to live in.
If it ends up by chance similar to a house that someone else has drawn up but you came up with it independently I'd say you have a stronger case than just saying you copied the plans... Re: "Mark & Melissa's Build Blog" 17Jan 11, 2009 12:42 am Ed,
Is that why some display homes do not allow cameras or vedios, so they can prevent ppl copying their design?? I saw the sign at the Carlisle's office window. Was going to take few shots so we can remember what we saw and get some ideas about the interior decor...but..the sign stopped us. I think so far i only noticed that warning from Carlisle... but really, they have the floor plans and photo gallery on the website anyway, so if ppl want to copy them, they still can! i guess if we request it as a customer for our future home, they'd let us do it? Re: "Mark & Melissa's Build Blog" 18Jan 11, 2009 12:46 am Yes, don't ever say you COPIED!!! It's a prohibited word even if you did! Same as even just photocopying the pages from a book is against the copyright law! But ppl do it anyway. Yes that is why they don't let cameras in - sorry I left out Carlisle... they have been sued too.... I always photograph my customers display homes - only 1 guy ever stopped me though (I have permission). It's not the same as copying books - you are alloowed to copy extracts from books as long as you acknowledge the authorship.
