Our house is a few months off completion, but the blocks next to us have just started or will be starting construction early next year, therfore our house will be finished before our neighbours.
When can we put our fences up? Do we have to wait for their houses to be finished also? Im concerned that our house can be easily accessed without fencing and we also have a dog, so really need to have the fences up as soon as we are in. Is there a fencing etiquette we should stick too? Not sure about when you can do it but general fence etiquette is that you ask your neighbours whether the materials you plan to use are ok with them, considering the fence will affect their land as well. You give them quotes and have them sign that they will pay half the bill, too. One thing you might want to ask them is whether they need the fence delayed for things like excavation in the backyard, etc. which is something they will need to ask their landscapers, builders, etc. Communication is the simple answer, no point starting neighbourly relations on the wrong foot. I'd recommend you get in touch with the owners, and work out a timeframe that is acceptable to both of you. They wont be unreasonable...lol, well i hope they wouldn't be, and sometimes it can cost more with some builders IF there is an existing fence and it hinders their access on site. The other things is, they might have to have a security fence errected anyway??? So you might be able to put off that expense for a bit and use their builders fence instead? Just another option. We definietly won't do anything until we speak to the neighbours. I wouldn't like it if they put one up without consulting us. I agree communication is key and you don't want them offside from day one (or ever for that matter). Just wanted to gauge what others thought. Re: When can we put up a fence??? 6Nov 28, 2008 12:08 pm In Victoria, you're perfectly entitled to have a permanent fence erected once you move in, or before if you want - and whilst it IS common courtesy to talk to your neighbour about it first, legally all you have to do is serve a fencing notice on the neighbour. As long as the fence you propose to build meets council and developer requirements, they really can't object - although if they want something fancy and don't want to pay the difference, things could get messy.
Bottom line is, make sure you've served the notice before any work comences or you can be left with the entire cost and no recourse to compensation. The Vic Law Reform Committee has some handy info here: http://www.parliament.vic.gov.au/lawreform/inquiries/Fences%20Act/QuickGuide/ - the index down the side will give you most of what you need to know. If you're in another state, you'll have to hunt around and see what you can find. The actual legislation is probably available online, but it can be tedious to read.... Your local council should be able to provide some guidance too. I think it's always best to be armed with all the necessary info before you approach the neighbours. Just in case. You can both get multiple quotes to be fair and as long as you are both happy you sign and therefore authorise the fence to be errected at a time suitable to both parties. Probably best for us to look for the NSW fencing guidelines, given that it could differ with NSW/Qld being on a completely different legal system to Victoria. I know the intentions are good but it's still best to chat to the neighbour first, whatever your rights, instead of just slapping them with a notice. I'd find it completely rude for someone not to take my build into consideration too just because they finished first and are legally obliged to do something that affects my block and possibly my build cost directly. We contacted a fencing contractor who asked us to go to teh council and get the info for our neighbours, he then does all the contacting, they were fine with doing it early! At the end of the time they require the fence, surely they have budgeted for it, and its one less thing to worry bout if someone else starts first cause they organise it you just say yep! I can only speak for NSW which might be useless to you but here, there's an application form that you can send to council if there's no neighbour in order to get permission to build a dividing fence.
