It sounds to me like your builders are trading whilst insolvent (which is illegal), and it's only a matter of time before they go under. Have a look at the Marshall Baker thread for a good example of the fallout when a builder goes under. Does your contract state that you must pay in stages (eg slab, frame, lockup, fix etc), or monthly ? If your contract says stages but you've "gone freestyle" and are paying monthly, then I'd suggest that you're asking for trouble if and when it all hits the fan. How do you know that what you're paying is actually going into your job ? I'd suggest that you need to raise a complaint with ASIC (you can do this using the eComplaint form on their site), alleging that the company is trading whilst insolvent, citing the conversations you had with the trades. You should also try to find out what suppliers they are using (try looking for old invoices or delivery dockets left on site), contact them and ask if they have put your builders on stop credit. Just be honest, tell them your position and that you're really worried about doing your shirt if your builders go under. I would be surprised if your builders aren't on stop credit with at least some suppliers - so not only will you have trouble getting trades to your site you'll also have problems with materials. I honestly think that you need to bring about some kind of change, on your terms, instead of babying along the builders and being an enabler for continued * practices. Thanks for your informative answer Justin, OH confronted them on Thursday and the construction manager said as far as he knew the tradies were being paid, OH advised them to check "upstairs" this is where the Director hides when OH shows up, because apparently they are not being paid. The SS sat in the background and said nothing, and OH threatened to get legal advice so we could go it alone. Still no-one was there Friday (perfect weather), I think their building life is limited. We have been watching another build with them not too far from us, the frame has been sitting onsite for over a week, not a soul in site. I would never build with Fowler homes.
