Browse Forums Building A New House 1 Nov 17, 2008 8:35 pm Some advice please. We originally signed up for a block of land in March 08 with title to have been June 08. We subsequently signed a contract for building a house on this said land.
Has anyone else ever been in the situation where land was bought from a Developer and a contract signed for building on that land. Within 150 days the land had failed to settle (originally due in June ) and a letter received from M stating breach of contract. We have been told by M that their builder is not at fault from their Developer having delays in receiving land title. M3tricon have issued a letter saying they are cancelling the contract due to breach and that if we still want to build we have to sign another contract and pay more money. Incidentally the Developer has a registered address at the same place as M3tricon head office. Are you by any chance up at Renaissance Rise in Mernda? The timing sounds about right, but other than that you will have to take a close look at the special conditions in the contract. Just so I have the situation clear is this what happened? March 08: You bought land. Titles were meant to be due in June 08. June 08: Titles were delayed. Sometime around June: You signed a contract with M3tricon to build a house on the land you had that hadn't yet been titled. Now: You've received a letter from M3tricon indicating the contract has been breached because you haven't been able to supply them with the land upon which to build the house within the allotted time. ### Is that right? Sounds like what we've been going through, but because our land and our house are both being built by M3tricon, they've been annoyed but haven't cancelled anything on us. If this is the case there is a definate conflict of interest. Whats to stop the builder from holding up their own developments to serve these notices and make people pay more money. jido I cant beleive M3tricon does not seem to want our money. grrrr They do want your money ... they just want more of it! Thank you for the welcome although I must admit I have been seriously lurking for some months. Spot on except we are building in Prominence, Tarneit . The land was sold to us by M3tricon on behalf of their developer so technically they own both the land and house contract although one is a developer and the other is the builder. There is no reasoning with our current CSC who appears to blatantly not give a damn about the fact that it is their developer that is holding things up. The silly thing is we have been told yet again land is due to be released this week. We cannot settle on any land we dont have title for. It's one of those catch 22 situations. I don't mind paying extra if it is our fault. I am sure there are others who have been in this situation, I was curious as to how they handled it. Being rung up and being blantantly told by our rude CSC they are cancelling our contract has not been a good start to the week. no coffee? no work!!! From the picture you can see the power was put in last so the electrician knew where the water was.
