However, has anyone been subject to a Post Contract Variation (PCV) of circa $23k for site works whereby costs were identified prior to signing of HIA contracts. The cost of our site works being approx. $30k was identified months prior to signing of HIA contract and communicated via email, whereby we accepted the increase and gave the go ahead to proceed. At this point, there was no communication advising rock removal would be a separate cost, therefore the assumption was site costs + rock removal would be a combined total of approx. $30k as identified. Upon signing HIA contracts, the builder had only allowed for a provision of $10k for site works & $10k for rock removal, despite having identified previously site works would be upwards of $30k. The build has advised our total site works is $43k, being $10k rock removal & $33k site works. It has now come to our attention, that the identified site works of approx. $30k excludes rock removal, hence the PCV of circa $23k. Given the site works cost was identified prior to signing of HIA contracts and the builder failed to allow for a reasonable provision, do we have any grounds to stand on here or is it a ‘bad luck’ situation where we need to front $23k?
