Some items have come in over the provisional amount. Our contract was a master builders contract. Eg provision for bricklayer labour was $14.000 then after begging for copies of our provisional invoices we have been hit with a bill for $21,000 in bricklayer labour. (Note: that nothing came up that would require the extra cost and everything was to the architect plans) $,5000 in extra timber for frame, $10.000 extra for pool and it goes on and on. Never once did our builder write to us or mention that he has gone over the provisional amount. We have just been hit with extra amounts. I had mentioned several times in writing that can we please have all variations sent to us in writing. What can I do? A few builders friends said we don’t have to pay as he would have received quotes for the jobs well in advance and had plenty of time to make us aware. Do I have to open a dispute with the QBCC or master builders. And will work be stopped until it is resolved. Or do I contact my lawyer? I would love to get some advice.
