Retaining wall to garage wall

Hi all,

I’m building my house and had CDC approved.
They made the retaining wall before the house slab.
On one side, the gap between neighbour fence to garage wall is less than 900 mm and from neighbours fence to retaining wall is 500 mm that left the distance very tight.
My question are:
1. under cdc what’s the minimum requirement need from garage wall to neighbour fence (boundary)?
2. What’s the walk way distance rules for walk way towards to existing granny flat at the back?

Can anyone help me with my questions please. And if they build not as cdc required what will happen?

This whole building process has been giving me so much stress as I have away from my house for more than 2 years.

Attached are the setbacks taken from page 149 of the State Environmental Planning Policy (Exempt and
Complying Development Codes) 2008

Basically, at the end of the build you have a surveyor do an ident or identification survey and if the home is in the wrong location you won't get an occupation certificate.

If it were me I would be getting the surveyor to double check that the retaining walls are actually built on the boundary before doing anything else.

I also want to add that if you need your CDC modified that is a pretty simple process.

If the garage wall count as the start point to boundary for 900 mm?

I booked private building inspector, can he check on this as well?

I believe it will, however there is one massive caveat to my advice.

We specialise in KDRBs in established suburbs so I have zero experience in new housing estates which allow for zero lot boundaries ( if that is what they are called), so I am not sure how these work.

Is there any way you can talk to the certifier who approved your home and get some advice?
