In the above picture we have our block and dimensions, shown in red. Where it says 'existing post and wire fence' would you say that it is the back of the property or the dotted line? We measured our property today and the length ended up at the existing wire fence.... before that, though there is a steep ditch (about 1.5-2 metres before wire fence), the property behind is much lower than our land, so if it was filled, there would need to be some type of retaining wall and our contract said 'no retaining wall needed'. It now has us, DH and I, a little confused, and hope that we aren't going to have a large ditch running across our yard, or even worse, a reduction our property length! You will have a embankment on your site. A retaining wall was not required to build the house but you may consider it to create a larger flat area to enjoy. I just assume no one pointed it out to you on the drawing. If the contract does not include retaining wall then you will need to pay extra to get one done. I am guessing that the ditch is referring to the #'s then at the top??? How can you tell how deep it would be? We were not told or shown any thing to do with that at all, and as we are having a fence put in, through the actual land developer, we took it for granted that all the blocks were flat/level and retaining walls would be/were put in for the fences. If the back fence is at the level of the existing wire fence, then it will be hardly worth having one at all, as the ditch is fairly deep. Re: land question 5Nov 02, 2008 9:26 pm By my understanding, your back fence will be along the red line. The existing post and wire fence will be over your back fence. Between the back fence ( red line ) and your house you will see another line - 'top of bank'. The land will slope down from this line towards your back fence by 75 - 80cm. The top of the embankment is at an RL28.8 approx and bottom of embankment at RL28.0 approx, therefore will be approx 0.8m height. Its where it says top of bank. Its a shame that no one told you. I tend to think they don't tell you because they are scared of the extra costs involved and try to keep it from you but as you know thats not good because your now got an embankment that will need not only a engineered retaining wall with building permit but aggy drains aswell. On the other hand can create an interesting landscape feature with step down etc, but all not as you expected unfortunately. grace16, if only it sloped, but its just drops.. a slope I could deal with. I guess we will find out anyway tomorrow, DH is going to ring up the developer and find out. The only thing that we had been told by the person handling the estate was that the land behind is owned by stockland for further development...but after a long internet search, I found that it is not stockland at all, but another company, cant remember who. I guess just that alone shows that the person handling it wasn't up to scratch. At the time of purchase the only thing we had seen was an estate plan, so had no idea of a drop/ditch being there at all. I am sure the developers did though, and if I was aware of it, there was no way that I would have bought it, instead we would have bought the other one in the same estate, that we were looking at. When you got the land contract it would have had a contour survey in it.... and you would have seen this before signing the contract. Did you check the contract and check the contour survey? Did you have a solicitor/conveyancer check over it? Check it again.... if it doesn't show a ditch on the survey you have a good argument to have the developer fill in and flatten for you. But if it does show it on the contour survey... then sorry but you signed it and there's nothing you can do. There will be a survey in your contract.... I'm almost certain it's a legal requirement.
